Compensation for my damaged luggage

Hello all...I hope you can advise me what to do.

I arrived at Heathrow yesterday.

One of my luggage was missing, however there was a similar one in colour but smaller than mine on the floor not collected.

It seems that person took my bag instead of his/hers.

I filled a form with the Baggage Global Solution at the airport and they said they will deliver my bag to me once that person returns it and they will hold his/her until he does so.

Today I got my bag delivered to home but the combination lock was half broken (2 zipper thingy, one was broken and forced with a screw driver) so I cant fully open my bag, I can only push my hand in. And the combination lock is not working even with my code which I remember without problems. The only solution is to break the lock and snap the other zipper bit this will make the bag useless without a working lock.

Today I called the Global Baggage Solution and they said they can't do anything about the lock matter.

The airline will probably say it has nothing to do with it since the bag was delivered on the belt.

I am not sure where or who did break the bag lock. But I think it was the person who took it by mistake, and after they managed to break one part and see inside the bag, they realised it was not theirs and returned it.

However I can't prove that and they will simply deny they have done it if I report it to police.

I have a travel insurance but not sure if that is covered in the policy since it could have happened after I returned from the trip.

I really don't know what to do.
Where to get the compensation for my broken bag?

    You shouldn't report it to the police, by your own logic it wasn't deliberate damage and no criminal intent.

  • Have you checked your policy then? No-one here is going to be able to predict what your policy covers you for.

    Then why don't you phone them and find out what they say?

    It seems that the person who mistakenly took your bag probably damaged it trying to open it. Therefore they are responsible for replacing the bag. But whether you can persuade them to reimburse you is another matter, as they may deny causing the damage. It will cost you to use Money Claim OnLine, which you could only reclaim if you won.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    If your insurance doesn't cover it, and the bag wasn't expensive, I'd probably just write it off. Not worth the hassle to me in pursuing the 3rd party who accidentally took the wrong bag.

    Of course you may have a different view on it.

    The inaurance said they won't cover this damage.

    I just can't understand how someone mistakes his bag with others? Our bags were different in size. And his bag was locked with a U shape lock, mine with combination.

    He forced a screw driver in the lock and damaged it. Now the lock won't work.

    To be honest I thought he might have left me a note inside the bag to offer a compensation for the damage, but I was wrong.

    I was watching an episode of 'Border Security' last week
    (I think that's what its called - airport documentary type show that you get on TV showing the work of the security officers checking peoples bags etc)


    They stopped a guy flying into Canada to check his bags - narrator didn't say whether it was just random spot check or if they thought the guy looked a bit shifty




    (paraphrased)


    Security "Are these your bags", "Do you know what's in these bags", Anything in them that shouldn't be" etc


    Passenger "they are my bags, yes I know what's in them, nothing that shouldn't be"


    Security guy opens a bag and looks up - "this is your bag?"


    passenger sees some of the contents "oh wait, that's not my bag"


    Security "well, you told me this was your bag"


    Passenger "I must have picked up the wrong one from the carousel"


    Security "this is quite a distinctive bag and you've picked up the wrong one"


    (doesn't believe him - bag is blue but with a piece of thin rope tied around it - to be fair to security guy it was quite distinctive)


    Passenger "its not mine - that isn't my stuff. I've picked up the wrong bag"


    Security "so there are two bags on this same flight that look exactly the same"


    Passenger "must be"


    Security "lets go and look shall we"


    They go back to the carousel and there is another bag - absolutely identical down to the piece of rope around it. They sort it out - identify the second bag does genuinely belong to the passenger - check it - nothing wrong. Apologise to the guy for doubting him - they all have a laugh about it and passenger goes on his way with a new story to dine out on.


    Was an amusing little episode to watch :)
