Yes the DWP will expect repayment but they may take sometime to write to you about it.

Not sure but I think you can take the forms to the Probate Office by appointment which might save some time.

DWP are fairly efficient in sending you information about what you need to pay back. I think I got a request to refund the overpayment a couple of weeks after my dad died. It won't prevent you going ahead with probate, but you might want to estimate what is owed for the IHT form. If in doubt as to the amount I'm sure they can help if you call them.

I did the online IHT form and probate application then swore the oath and submitted the forms (which my mother and brother had signed elsewhere) at Winchester. I submitted just over a week ago so am still waiting for the grant to come back.
