parking charge

I've received a parking charge in a private car park for not displaying my permit. My permit was displayed and was very near to where the operative placed the charge notice but it was late when I left the car park and only read the notice when I got home. I have appealed and as there is apparently photographic evidence (7 photos!) so I've requested copies to be sent to me but on the appeals form it says that I have to have photographic evidence that the charge is incorrect. I have heard that these companies have to issue charge notices instead of fines and they are not legal but the notice says they will contact DVLA if I don't pay, and will pursue me. Can they do this? I thought that would be a breach of data protection. The company is Comprehensive Management Services and the fine £100 reduced to £60 if paid within 2 weeks. I'd appreciate any advice. Many thanks :(

Update - i have received an appeal confirmation email saying they will endeavour to respond within 28 days, however the appeals process does not alter the discounted period. I'm staggered!

They have to supply you with their evidence at some point so don't worry.

They are member of the IPC who do not have a decent record of upholding appeals at their IAS appeals service. So don't worry if they turn down your appeal and then the IAS does the same.

At some point, they must come clean with photographs. Are you 100% sure that your ticket was on display?

If they demand evidence of the permit on display, then put it on display, take a photo and send it to them. See how they like that !

Yes I'm 100% sure. I took it off the dashboard so it didn't fly off while I was driving. I just wish I'd read the notice and taken a photo at the time. I'll take a photo next time I'm at the car park and send it through to them while I'm waiting for their photos. Thanks for your help

I hope you have read the NEWBIES thread (top of the forum) now and realise:

    - they will turn the appeal down

    - any photos might have been taken 'at a jaunty angle' so the permit wasn't shown clearly (some firms do this deliberately)

    - IAS is usually pointless - but if the photos come through & show the permit, it might be worth discussing IAS stage here. You are still likely to lose - have you Googled who runs the IAS...read some Parking Prankster blogs about Mr Hurley and Mr Davies?

    - the discount means nothing to you but who cares about that?! You won't be PAYING them!

Read what's here already about IPC firms, all much of a muchness. Not worthy of your money.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
