Had a brief look and couldn't see this already, wasn't sure if the regulars knew about this result:

Peel Centre, Stockport, comes up frequently on this board ...

“It is disappointing that Mrs Backhouse did not engage with us earlier as this could have avoided the matter proceeding to court.”

Utter BS. If the lady had engaged it would have made no difference whatsoever ... Excel would have still had to proceed to court to try and collect payment; there's a negligible chance that Excel would have cancelled the PCN on appeal.

I think "engage" in their language means "pay up".

I thought we were going to read a nice story on how the Peel centre has been successfully sued as a result of the actions of its agents (Excel)

but oh well, more of the usual rubbish.
"Carol and Claire Backhouse say others can use their technicality to beat Peel Centre fines"
While the Protection of freedoms act does lay down some conditions that parking companies have to comply with in order to hold a vehicles registered keeper liable, it is not the be all and end all.

If a private parking company fails to comply with the protection of freedoms act, and the registered keeper admits they were driving, or fails to convince the judge they were not driving - its not been unknown for the judge to decide the RK was driving on a balance of probabilities then things can take a turn for the worse there are other things that must be used as well as failure to comply with POFA when dealing with parking companies in court

When will these landowners realise that such publicity can only be seriously detrimental to their profits.

I'll edit the title to make it clearer.

Carol, herself a legal officer for a housing association, said: “It is quite a groundbreaking case, the judge said she had not heard that argument before.

And in the comments section of that report .....

"Unfortunately the comment with regards to ignore them and they will go away is untrue. I won my case last Week against excel relating to 13 tickets I received at the peel center which they lumped together. The first dating from 2013. The first court case relating to the 13 tickets was adjourned because excels solicitor came to court with no evidence or documents. Totally unprepared (agency solicitor). It was adjourned till last week in which no representative for excel turned up. The judge threw it out of court and ordered excel have two weeks to pay me compensation for wasting my time."

THE SOLICITOR .... SOUNDS JUST LIKE BWLEGAL

Be sure, if the compensation is not received in time to make them pay for their tardiness. Cause them as much pain as they have caused you.
