Ebay seller refuse refund due to packing being opened

The vast majority of shops don't have headphones available to inspect, some that do don't have every make and model available and you certainly can't just get the scissors out and open the sealed packages in shops.


The law clearly states that doing anything to diminish the value is deductible and for me I wouldn't want an unsealed pair of headphones at any price for hygiene reasons.

Perhaps you'd like to quote where the law clearly states that? Because the law i'm looking at says no such thing.

However diminished value is moot when you're discussing an item that is possibly sealed for health protection/hygiene reasons and that has become unsealed after delivery.

I can see and understand the reasoning for not allowing the return of such things as in ear phones because of hygiene concerns but testing a pair of over the ear headphone isn't really that different from trying on a jumper that you need to pull down over your head.
