Excel Parking Ticket 2010

Hi,

My wife parked at an Excel operated car park back in 2010, the car was registered in my name.

My wife bought a ticket and parked in an area as pointed out to her by the parking attendant. On returning to the car she found a ticket on the windscreen saying the car was not parked in a valid space and a fine should be paid. I googled excel parking at the time and decided to ignore them.

A number of letters were sent to me over the years, all ignored.

7 years on they are threatening to take me to court.

Any advice?

Thanks for your help.

Excel playing mind games again, after 6 years it times out for court action ....

Excel use the highly incompetent BWLegal as their legals or maybe SCS Law
Both of these should realise that this has timed out.
It's a try on. Any further junk mail from them or court action, come back here

The Excel scam is well known, run by an ex wheel clamper who had his feathers ruffled

Sounds like misuse of her data contrary to the DPA principles:

    https://ico.org.uk/for-organisations/guide-to-data-protection/data-protection-principles/

''Personal data shall be processed fairly and lawfully and, in particular, shall not be processed unless –

    (a) at least one of the conditions in Schedule 2 is met, and

    (b) in the case of sensitive personal data, at least one of the conditions in Schedule 3 is also met.

Personal data shall be obtained only for one or more specified and lawful purposes, and shall not be further processed in any manner incompatible with that purpose or those purposes.

Personal data shall be adequate, relevant and not excessive in relation to the purpose or purposes for which they are processed.

Personal data shall be accurate and, where necessary, kept up to date.

Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

Personal data shall be processed in accordance with the rights of data subjects under this Act.''

I would send Excel a cease and desist letter or email (keep proof of sending) mentioning the above and heading it up 'formal objection to processing - section 10 of the DPA'. You will find examples here by searching the forum for keywords like:

    'objection to processing section 10'.

And then put together an ICO complaint that, if upheld, can pave the way to you claiming 3 figure compensation for this untimely and unwarranted harassment.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
