I am looking for some help with my Personal Injury Claim,
Third party has accepted liability, I am currently dealing with a company which I will not name but it seems that they are dragging there feet.
Accident 31st August 2016, car coming from the left hand-side i tried to dodge the car by going up a curb on my right hand-side, the car then hit my passenger side which sent me swerving across three lanes of traffic onto the pavement on the other side of the road, during this time I have sustained some neck and shoulder injuries, my left testicle had been knocked and worked its way inside, when I arrived at the hospital they where talking about surgery etc.. I managed to dislodge the testicle and worked it back down, following days of check up at the hospital they said it needed to be checked regularly, since the accident i was suffering with pain in the testicle and stomach area I visited my Dr and explained I was having issues keeping an erection and during sexual intercourse my left testicle was rising up and inside and causing mega pain resulting in losing my erection. He sent me to be seen by a urologist who said that my testicle was going into my inguinal canal? he recomended surgery of scrotal orchidopexy which I have since had done, I am still waiting to be seen by the Urologist for the claim process 8 months on, I have asked for a second Interim payment to be made as I have been off work for 3 weeks without pay from work due to complications from the surgery etc.. 5 weeks down the line and the third party after having my urologist report the Drs report from the insurance company who both agree that this is a result from the car accident etc.. the claims people dealing with this are telling me that there is nothing that they can do without the official urology report to the court before they can push for an interim payment. I have also asked for information as to a value to the claim which they are telling me they are unable to give me an idea of? I have copies off all the medical reports drs reports etc.. which they have also.
is there anything I can do to speed this up? can anyone give me more information as to a possible value of the claim and how I can proceed to push for the interim payment as currently I have had to cancel Direct Debits and rent payments I have explained this to the insurance company who tell me there is nothing they can do without an official instructed urologist making a report to the court! If anyone can shed anymore light or give me any pointers it would be greatly appreciated.
sorry if the wording is all over the place.
thanks in advance
Rob

Unfortunately there isn't anything you can do to speed this up.
No one give you an idea of the value of the claim until they know the full extent of your injuries - and these are what the medical reports are for. This isn't a usual situation, like a 6 month whiplash injury, so isn't easily quantifiable. Once all the medical reports are in, THEN your solicitor will value the claim, as it depends on what the Urologist say in his report, as to whether anything further is required.
The issue is that you need to provide evidence, even if you want an interim payment. When did you have the first interim payment, and what medical reports did you have at that point? Usually you will have to include further medical evidence in order to receive a further interim payment.
Is the urologist examination booked in? If not, then chase with the people handling the claim (I will assume solicitors) will need to instruct the medical agency for quotes, they will then send these onto your solicitor who will usually then send these onto the third party insurers, as they are the ones that pay for the report, sometimes solicitors ask the insurers to nominate one of the experts.0 -
Thanks for your reply, the interim was paid in December to cover the medical costs that I paid out for the issues that came immediately after the accident prescription costs of more than £350 which I know now a pre paid prescription certificate would have helped me. the third party have now got copies of the urologist report the medical assessment report which all point to issues being caused from the accident, they have a copy of the hospital and GP records etc.. so they have all medical evidence except the final urology which is post op and that will not be produced for another month or so. the third party initially ignored the interim request for 6 weeks so the claim was removed from the streamlined process? so I have been told not 100% sure the difference this makes the case was transferred to a major claims handler at the end of December but it seems from this move I cannot get any real information from them I just keep getting told to wait an update.0
