Car repossesed, tax surrendered.

Options
End of last year, our son got into some financial difficulties whilst living away from home. This led him into falling behind with car finance payments. The finance company repossesed the car. We helped him out, Bank of Mum and Dad, and he got it back. Just by chance, we were looking at Gov. vehicle check for a tax reminder for a motorbike of mine. Having done that, I entered our sons car details. It came up SORN! Son has a DD every month for Road Fund tax. My query is, did the car have it's tax refunded whilst in their care and should they have told my son when he picked the car up. Now no tax discs are issued, how is one supposed to know this has been done?

Under the new system VED is not transferable. Therefore, any refund can only be paid to the individual that taxed the vehicle in the first place. I stand to be corrected but, at least, that its my understanding of the new rules.

Correct, so any refund due should have gone back to the OP's son.

I'm surprised the finance company didn't make it clear when they returned the vehicle that it needed taxing.

And as for the OP's comment about the abolition of the tax disc. I remember threads on here in the 'good old days' where individuals had bought a car and been driving around in it with a seemingly valid tax disc on display, not realising the previous keeper had declared the disc lost/stolen and claimed a refund just before they'd sold it on.

Did the finance company take ownership and then re-issue it to your son? So there's now 2 additional keepers? That change would invalidate the tax (and he's been paying tax on a non-existent account for a while). I don't think they'd identify the fact he's got the same car back.

I'd try and tax it again, and then contact the DVLA (?) to get a refund on the missing payments.

Where have people been living since October 2014? In a cave?

DVLA now aware and dealing with the issue. Reassuringly our son's car is taxed now but problem caused by repossesors and no, no notification given from any party that the tax had been refunded although the monthly payments had been received. Seems a poor system that could have resulted in an awful lot of trouble

i often buy cars that previous owners havent advised dvla they have sold so when i apply for the log books i often get their tax refunds a few weeks later too
to be honest i rather wouldn't because twice last year dvla asked for them back up to 3 months after i had cashed them
