Holiday Injury

On arrival to my hotel on my thomson package holiday to Bulgaria, my partner and I noted that the very large sink in the bathroom seemed to be not affixed to wall very securely. We took a photograph and reported this to the reception and housekeeping. We would have told the Thomson rep but they were off sick for the full week we were there. Nothing was done about the sink and about midnight on our the 3rd night of our 7 day break it came crashing down off the wall shattering into many pieces and landing on my feet. The bruising and swelling came up immediately. My partner turned off water and rang reception, they came and cleaned up and then moved us by lunchtime the following day. I literally hobbled around for the rest of the holiday unable to walk far without pain so sat by the pool. No shopping / excursions / beach etc We showed the injuries to my foot and small cuts to reception they said we could keep the room a few hours later than check out time.. The pain while walking lasted 10- 14 days and I had to arrange for my sister to bring my dad from Cardiff to Birmingham in the middle of the night to drive us home as I couldn't drive my car because of the pain and immobility. The injuries healed but if that sink that I warned them about fell on a child it may of killed them......
I complained upon my return in June 16 to Thomson. After two unsatisfactory letters back saying thanks for letting them know, they passed to their legal department and I still haven't heard anything. Would I be entitled to any compensation? should I continue to pursue this?

Did you visit a doctor?
Do you have a record of issuing the photo to reception prior to the accident?
If the answer is yes to both then consider a good no win no fee lawyer.
Thomson are very likely to fob you off.

I didn't see a doctor but do have plenty of photographs of the bruising and swelling.
I also still have the photos of the sink in situ with close ups showing where I thought it wasn't securely fixed to the wall. When I showed it to the reception and hosusekeeping staff they fobbed me off saying it was fine and they were all fixed the same. (they were fitted differently with a supporting pillar in the second room I was put in).
I thought Thomson may fob me off after almost 10 months gone since the holiday. I sent Thomson all the photographs.0 -
Not seeing a doctor either here or whilst on holiday is going to hamper your claim, presumably now your foot looks and works fine? I suspect Thomsons is hoping you will go away and they will close the file.
Without medical evidence the value of the claim is not going to be great so you may find some solicitors unwilling to take on the claim, your best bet maybe someone like Irwin Mitchell, they tend to litigate by press release, to try and find others who may have been affected, although in your case that is unlikely.0 -
You should have seen a doctor and got a doctors report straight away. Although you say the rep was off sick there would have been a rep visiting, or a number in their information book where you could contact the local office. You should have got them to come out and look at it, and also filled a complaints form in.
Unless reception have logged the fact you reported the sink and showed them a photo, and without a doctors report, or proof how bad your injuries were at the time (other than by photos you took yourself) I'm not sure how far you're going to get.0
