Late licensing penalty/SORN
Hi everyone
I've received a fine for not having road tax on a car I part exchanged 2 months ago. The car was taxed for 12 months and the documents was sent, but obviously the trader has claimed a refund on the tax, but the DVLA are claiming that I'm still the registered keeper, if so how comes I didn't receive the tax refund but the new keeper did?? Ive sent a letter stating the documents were sent but they insist I must pay the fine.
What can I do?

I don't know where you live, but in Northern Ireland the seller fills in part of the vehicle registration document saying he's sold it to the dealer and that is sent to the vehicle licensing office. We then get a letter in the post confirming we're no longer the registered keeper. There is also a seperate form you can send in to inform them you've sold the car.
If you have documentary evidence stating when you sold the car and to whom, then they should investigate it further. Have you asked the Dealer if he informed them he was the new owner?Norn Iron Club Member No. 252 :beer:0 -
Bigcammy, Im in London. I filled in the form and the trader wanted it left so he could fill out his bits, I also wrote to the DVLA to let em know I'm not the keeper. This was the first car I've sold so was guided by the trader. But as I said he has claimed the tax refund therefore he surely must be recognized as the new owner, otherwise we all could go out and nick tax discs and claim the money back

A motor trader sends off the yellow part. This registers with the DVLA that the vehicle is with a trader but doesn't change the name of the Registered Keeper.
It would be worth ringing DVLA and speaking to them direct, stating you sent off the V5 and that you also have a receipt from the trader.0 -
Connor, I tried ringing the DVLA and was informed that you only ring to pay the fines not to appeal, that you have to do in writing, which i have and they still want to fine me. The gits.0

Hopefully you got a receipt from the trader when you sold it to them with the date on it.
I once refused to sell a car to someone who said they were a trader as they said they had no I.D. on them when I asked for it.
I thought even with a trader you still send off your little bit on the form yourself.
Can't depend on others doing what they say they will do.
Years ago outside the Croydon car auctiions I sold someone a car and they said they would send off all the documents and a few weeks later I started getting parking fines, but luckily I went to the Met in Croydon and they sorted it out.0 -
I've still got the receipt but I didn't send a copy in, although I did give the name and address of the trader. I got the " Thank you for your response but you still must pay 40 quid" yesyerday, and they want the fine paid by tomorrow.0
