Money split, but one person has passed away

Hello,
A few months ago my father passed away, and had some money in his bank account. As well as myself, there is a half brother and half sister of mine, both share the same father as me.
So, my half sister became administrator, and split the money between us three, we all agreeded and received some payment.
However, there was a minor dispute over weather my late rather actually owed some money back in possible benefit overpayments, so some money was witheld until DWP investigations have been completed. It was agreeded that this money would be split equally between us three, once all was sorted. The money is currently with the solicitors.
However, a month ago my half brother passed away too. So my question really, is what happens now to this remaining money?
Does it get split betwen myself and my half sister, or does it still get split between all three of us, even though my half brother has passed away. If the latter is the case, then ultimatly my half sister will receive it, as she is my half brothers next of kin.
Just interested to know.
Thanks

Do you mean she is a full sister to your half brother.
Does your brother who you have lost not have a wife or children.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Hello,
Correct - my half sister is FULL sister to my half brother (the one who has passed).
My half brother doesn't have a wife or children.0 -
The money forms part of your half brother's estate.Did he leave a will? If not the intestacy rules apply. Next of kin has no legal meaming in this context.merlinbrent wrote: »Hello,

Hi, - so does that mean it will me by half sister that receives the money, as she is his only relation, and i'm only his half brother. so presume she will get it and I wont?
Thanks0 -
It seems so.
Half sister might just want to share it anyway, depends on your relationshipmake the most of it, we are only here for the weekend.

Although given that she's now lost both her father and her brother, this may not be top of her list of priorities at the moment. All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have, not could of.0 -
The money was your half brothers, and it's now part of his estate.
If your half sister and half brother were full sister/brother to each other, then under the intestacy rules she will inherit all his estate as there are no closer relatives.
In short: you will still get your third; she will get her third; she will then get his third too when she wraps up his estate.0 -
Unless half brother's mother is still alive ....0
