Hi I recently purchased an item from Ebay as a birthday gift. The item arrived and I have given it over. I have been contacted by the seller today who states that there has been a mistake at their factory and a more expensive item was sent to me. I didn't know this and the item has been given over as a gift. They now want me to ask the person I've given it to to confirm the product they actually have. Where do I stand? I'm loathe to ask the person I've given it too as he's very happy with the present and is currently using it. Am I liable to pay for this more expensive item? I've already paid in full for my original, albeit cheaper item. Otherwise, I'll have to have the present back which I obviously don't want to do.
If it does turn out that he has the more expensive item where do I stand?

No idea of the price difference, they haven't told me. All they have said is that there was a mix up at their shipping office. I ordered a scope and received a scope. I have no idea what the difference was - the order label with it just confirmed my earlier purchase0

I need to know where i stand legally because if this item is a lot more expensive, I'm not going to be able to pay the difference and it means that I have to have a birthday present back.0

I think this comes under sent in error, so it needs to be resolved at YOUR convenience.
I would respond saying the item has been gifted and used, and you are not really in a position to ask for it back as that would be rather embarrassing for you and put you in a very awkward position. State that you bought a scope, received a scope, and it looked just like the one you had ordered.
I would then see what they say...Should've = Should HAVE (not 'of')

If they are asking you to confirm the item you received it sounds as if they don't know what they sent.
I would be inclined to ignore them.0
