Wrong item delivered?

Options
Hi I recently purchased an item from Ebay as a birthday gift. The item arrived and I have given it over. I have been contacted by the seller today who states that there has been a mistake at their factory and a more expensive item was sent to me. I didn't know this and the item has been given over as a gift. They now want me to ask the person I've given it to to confirm the product they actually have. Where do I stand? I'm loathe to ask the person I've given it too as he's very happy with the present and is currently using it. Am I liable to pay for this more expensive item? I've already paid in full for my original, albeit cheaper item. Otherwise, I'll have to have the present back which I obviously don't want to do.

If it does turn out that he has the more expensive item where do I stand?

Many thanks

Would it have been obvious it was a different item? Any idea of the price difference?

No idea of the price difference, they haven't told me. All they have said is that there was a mix up at their shipping office. I ordered a scope and received a scope. I have no idea what the difference was - the order label with it just confirmed my earlier purchase

I'd probably ignore it then - they need to be more careful when shipping.

I need to know where i stand legally because if this item is a lot more expensive, I'm not going to be able to pay the difference and it means that I have to have a birthday present back.

I think this comes under sent in error, so it needs to be resolved at YOUR convenience.

I would respond saying the item has been gifted and used, and you are not really in a position to ask for it back as that would be rather embarrassing for you and put you in a very awkward position. State that you bought a scope, received a scope, and it looked just like the one you had ordered.

I would then see what they say...
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

If they are asking you to confirm the item you received it sounds as if they don't know what they sent.

I would be inclined to ignore them.
