I paid twice for ticket parking at Napier Parking Milton Keynes - Not refund given

Dear all,

I have parked on 30th of March 2017 in Napier Parking in Milton Keynes and after carrying out the first transaction I saw no ticket coming out of the machine to display on my dashboard.

Straight away and to make sure I paid, I made a second attempt and to my surprise I received two tickets, which means I have been charged twice.

I didn't hesitate to e-mail Napier parking with pictures of my tickets and all I have received as I response is that it was my fault for not looking properly for the first ticket as according to them the machine was working perfectly, and no refund will be made. It was an all day price of £8, so I ended up paying £16.

I feel ripped off and have already raised it with BPA (British Parking Association), but I am open to any advice.

Thank you,

Veganfluff

Sounds like you have been stuffed and this is an unregulated industry.

I believe Napier own that car park and are a nasty bunch that have everything pretty much sown up anyway

The BPA are just an old boys members club anyway, who won't do anything but protect their paid up members.

How did you pay? Cash? Card?

If by card then contact your card provider to have the 2nd transaction reversed.

If by cash then you're stuffed.

If it was me and I paid by cash but had conclusive proof then I would create a Small Court Claim just to show them that I would not be mugged off regardless of the amount and it would be purely a principle based decision to do this, After all show on the other foot they would not think twice about doing the same if they could.

You do not need conclusive proof. The judge only needs to be satisfied "on the balance of probabilities" that you are telling the truth. Send them an LBA, it costs nothing.

It would be disproportionate to use the courts to recover a debt of £8.

Perhaps ... but a LBA costs nothing and the parking weasels might act on it anyway. :)

I often state on the balance of probabilities myself but would still want to be going into any Court with a sure as hell chance of winning the case.

Was there not a post very recently where a PPC took a motorist to court over 20p?

Yes I see your point but you could add on any costs incurred and interest and while it may not be a great amount to seek there is not a minimum limit set out as such by the Courts from what I believe.

I have sort Court action around years ago for £48.00 plus interest and won, I did not get told it was a waste of Court time and had tried to get back the money owed directly but was told to go away and then the Company became abusive so action was taken purely out of principle.

The BPA won't help you as Napier are AOS members of their deadly rivals, the IPC. I doubt the IPC will help you either.

Both the BPA and the IPC are member trade bodies, charged with protecting their members' interests. They will have absolutely no concern for a consumer.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
