eBay bed wonky! Help

We ordered a carved, heavy wooden bed frame from an eBay seller, brand new (they sell furniture and have very high number of positive feedback). We've opened it and and got it into position to assemble and the headboard is wonky, by about 2". The leg on either side of it are different in length by 2", and they cant be cut down to level it as they are carved/ornate (not sure of correct term)
I've emailed the seller but as yet not heard anything back, it was expensive (£600), so just wondering where we stand??
We paid for it with Paypal Credit, if that makes a difference?

Thanks! Have just gone through the Paypal process anyway saying its not as described, its just a pain and bedroom all finished, old mattress disposed of and a new mattress ready to put on a frame! So frustrating0
