Copart vehicles auctions - stated cat D instead of C

Hello

Please help.

Bought a vehicle using Copart (vehicles auctions site). In the advert and in the documents they stated the vehicle was cat D. Repaired the vehicle, used it for 2 weeks, unfortunately too small for the family so we decided to sell.

The buyer contacted us and accused us being liars as the vehicle was cat C not D.

We run the check and yes it was C.

We contacted Copart, they said not their problem, we should have checked before we bought it.

But what about that the goods are supposed to be as described and also it is illegal to state incorrect category.

Coparts doesn't want to know. what shall we do next. We would like the difference in the price we would sell cat D and cat C. it will be pointless just returning the vehicle as already invested a lot in it.

    How many vehicles have you purchased from Copart?

    I suspect post #2 may have been angling to determine if you were a dealer rather than a consumer. That said, I'm not sure if the Consumer Rights Act 2015 has certain exclusions when it comes to auction purchases - if the legislation doesn't have such exclusions then you've been mis-sold, as goods must match their description.

    You'd be entitled to a remedy (repair, replace, refund) but none of those suit you. (Refund is the only logical remedy the seller may offer). You can try to negotiate a refund of part of the sale price but the seller doesn't have to agree to that.

    If the seller won't play ball then you may need to get legal with them, but I'm not sure what your options would be.

    I think your complaint may need to be directed at the person who sold the car rather than the auction house.

    The following may be of some help, although it may be out of date in, at least, some respects e.g. the reference to the Sale of Goods Act 1979.

    Surely your loss is the difference in the purchase price between Cat C and Cat D, you bought the car to use, not to sell on.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Once repaired the value of the car is the same. Where you have lost out is the value of the car when you bought it. Cat C's are generally cheaper than Cat D's but not always so it's difficult to quantify the loss.


    I have been buying from Copart for years, I generally tend to stick to Cat D but have bough a few Cat C and they sell for the same so you have no loss.


    But then again you have already sold it so whats the problem.
