Claim on PPI rejected by Insurer

I had PPI with my mortgage and was made redundant but the insurer refused to pay because I had some self employed income(very small). I thought that I could get my premiums repaid but after my complaint was referred to the Ombudsman, he said no - the policy was fine and my self employed income was within limits and suggested I approach the insurer. The insurer is demanding lots of evidence (2012) but my ex employer says they haven't got the records any more. It seems harsh that I can't get my premiums back nor can I get the insurer to pay me the benefits which were due. I am thinking of going to the small claims court - may I ask what you think?

The FOS response is consistent. I have seen others where the FOS has ruled the same way.The insurer is demanding lots of evidence (2012) but my ex employer says they haven't got the records any more. It seems harsh that I can't get my premiums back nor can I get the insurer to pay me the benefits which were due.
You are not getting your premiums back. They are looking to see if your claim should have been paid out at the time.
This requires you to evidence your income.I am thinking of going to the small claims court - may I ask what you think?
Very few successful cases and the requirements are much higher than the FCA complaints process and FOS. The onus is on you to provide evidence.
