Parking ticket ccj

Hello,

Due to the advice of many to ignore my parking ticket from civil enforcement I have received a letter from the court ordering me to pay £350! They say I have 28 days to pay otherwise I'll have a ccj against my name. What do I do with this? If I dispute it then I could loose and have to pay more. Any advice would be amazing ?

    I think you may have to pay then try to get it overturned by paying £255 for a set aside judgement, which you will get back if you win.

    You will need a very strong case for doing this. Ignoring everything because you used old out of date advice (the advice to ignore has not been given on this site since the law changed in 2012) will make this an uphill battle unfortunately.

    Had you, say, moved and not received the original paperwork, and had a good prospect of beating the scam on legal grounds as recommended and successfully used here, you may stand a chance, but simply having ignored everything will not go in your favour with the courts.

    Oh dear! Civil Enforcement (CEL) are so easy to beat. They never see a case through to court when up against a forum assisted defendant.

    If you have a letter from the court then they have your correct address so I'm guessing you previously chose to ignore the county court claim form with the court stamp on?

    You'll have to pay the amount requested if you want to avoid a CCJ. You can apply for a set aside which, if granted, will set the case back to day one - when the court papers were first issued; then you can defend accordingly.

    Problem is you need a valid reason to request the set aside and, as Fruitcake says, just saying you were 'told to ignore' is not a valid reason.

    If you get the set aside and win your case (which you should against CEL) then you get the £350 back and may get around £100 costs awarded. But it costs £255 to request a set aside and you're not guaranteed to get this back.

    Please answer if you received any court papers before the case was heard.

    Also, as some other people have been caught out on this, did this letter come from the court or is it actually a threat-o-gram letter from a solicitor, possibly Gladstones.

    What , i think, GD means is have you contacted the court or is this just a letter from CEL?

    ...................or their solicitors or a debt collector. Has been known for OPs to mistake a debt collector or solicitor's letter as being from a court.

    If this is a Judgment for Claimant, the OP should read saggi's thread on how to turn this around, as this poster even got the claim struck out and her £255 set aside fee refunded straight away by order of the Judge:
