I was in exactly the same position in January. :eek: SC only wanted me to reduce for one month, haggled to two then I called back on the second month saying I needed three which I said at the outset and they were fine.:j

I'd like to be able to say I've been away on a fantastic holiday and am just back home - but unfortunately life didn't interrupt quite so nicely. However, without going into details the family are all okay and we are all still here alive and {almost} kicking so I'll take that as a huge win;)
Add to family dramas - the boiler gave up the ghost whilst we were on holiday so having that checked out (man coming later today). Fortunately up to £1.5k of repairs/replacement is covered on the house insurance so even the boiler going wrong is not too bad - it's inconvenient, but we can live with inconvenience now and then
I didn't realise how much I would miss you all - even though life has been very manic I have missed keeping up with my virtual friends. I also very much look forward to getting to know the new members of our group.

I hope everyone is OK and that you've recovered from your holiday (It's so wrong to say that isn't it?)
I'm going to save this post whenever anyone posts an SOA here and asks why they need insurance, as it's one of the biggies and people always are sent into a panic when their boiler breaks.

There's no time limit to CCA requests. However the newer the debt, the more likely they'll have it as banks started to realise that not keeping their paperwork in order was costing them. Some banks however still aren't too great at it and there's nothing to lose by sending the requests.

I will continue with my complaint. Stating that as they are refusing my full and final offer and refusing to apply a default they are stopping our chances of moving to a repayment mortgage and the chance of remortgaging in the future.
NRAM are actively asking customers to leave, and there's no chance of us doing so unless they help a little0 -
Quick question all
When starting DMP with SC they say, where loans are concerned, to multiply your monthly payment by the number of months left on your loan and you will have the magic figure for the DMP amount (I think :undecided).
So doing that gives xxxxx figure. My loan has defaulted at yyyyyyy figure which is invariably less than xxxxxx figure :j:j. I'm sure the default is the exact amount owed as they cant add any more interest or charges (....again I think) if so do I need to update SC for payments.
If this is the case is reduces my balance by about £3,000 which is not to be sniffed at. :T

Could I ask for a bit of advice?
Had a letter from Nationwide today regarding my loan account. I have never written to any creditors about unenforceable debts so wanted to clarify this letter.
The letter states that Nationwide have "identified an issue with some of the arrears statements we sent to you in respect of your personal loan" and that "in light of these issues identified, this means that we will not pursue court proceedings to recover this debt."
It then goes on to say that "due to these issues identified, we would now like you to consider whether you would like us to add a Notice of Correction to your credit file in relation to this default. The Notice of Correction wording we would add to your credit file, if you ask us to proceed, is as follows - Please note that this default relates to an agreement which the creditor considers to be unenforceable."
So, my questions:
1. Does this mean that I no longer have to pay this debt? (although the letter states that this does not affect the payments due in respect of the loan, the loan is still in default and the agreed payments are still due).
2. Is it worth me offering a low settlement amount to get the loan closed on my credit file?
Not sure what the next step is - obviously I will write and ask for the Notice of Correction to be added to the info on my credit file but would love the expert advice from you guys on here

Unenforceable in court, the choice is yours what you do, they can do nothing to enforce the debt.

Hi all,
Just a quick update and a couple of questions.
I wrote to all my creditors on 12th May requesting a copy of the CCA's.
So far
Idem(Halifax) unenforceable
PRA(Barclaycard) Unenforceable
NCO (HSBC) still waiting account on hold
Robinson Way (Tesco) Still waiting account on hold
Lowell (ASDA) still waiting account on hold
Nationwide have cashed the £1 cheque and deducted it from the balance, completely ignoring the request.
I intend to send follow up letters to NCO, Robinson Way, Lowell, and Nationwide, repeating the request. My first question is how long do I wait before assuming the can't find them and write saying I'm not paying anything else?
Secondly I now intend to write and tell Idem and PRA that I have no intention of paying anything else. Does anyone have a template letter for this or did you just put something together yourself?
It all feels very strange at the moment and very quiet. No letters or phone calls and working to get together an emergency fund.

Hi Julie! Was wondering how you were getting on. Sounds like things are ticking along nicely even though it's quiet it's probably good to be quiet than having the non stop phone calls
I have had a response from most of my creditors now. The ones who so far haven't or could not find my CCA's were PRA and still Robinsons. Capital One are taking ages and I keep getting pushed from pillar to post with these guys. All the rest have returned a copy eventually.
