Although there are no guarantees; chances are the former EGG one will be UE. My OHs Barclays/Prev Egg account proved to be so. If that is the case then I guess you can ask SC to remove it from your DMP and state that you want to prioritise enforceable debts -but you may find that they are reluctant to do so (their ethos is to treat all creditors fairly) in which case you will have to go self-managed -which is much easier than people think, especially when you are experienced with DMPs. Good luck with the CCA request
Well I bit the bullet and CCAed 4 of our creditors.
Two (including PRA) came back to say they had to ask the original creditors and hope to respond within 40 days but were putting the account on hold until they replied.
The third DCA replied almost immediately to say the original creditor didnt have the correct paperwork so they would no longer pursue the account and the balance was now zero - result !!!128513;!!!128513;
No reply yet from the fourth CCA.
Our remaining debts are old overdrafts, one opened in 1994 and the other (with First Direct) in 2004. The FD overdraft had a credit card balance added to it and described as a consolidated debt account - am I correct in thinking you cannot CCA overdrafts.
Thanks0 -
Can I ask ...how do I go about checking the CCA on my debts
They are both credit cards , one with Lloyds , one with Tesco
Do I send a letter , if so , is there a template I can use
Thanks in advance0 -

Hey Mikebec2010
What a stroke of luck with the CCA's! Can i just ask were all the requests for cards prior to 2007 or were there any for 2008 and later?

Congratulations! That's the hard part done. Try to relax a bit now:beer:
Can I ask what the position is with regard to the DDs that you said you'd be paying very soon? I assume you've cancelled them. Are SC paying your creditors the token payments on your behalf or have they advised you to do that yourself before starting the DMP proper? Have you contacted your creditors to explain the situation? If SC are paying them from now on I don't think it necessary for you to contact anyone but if not your creditors need to know that you are embarking on a DMP from xxx month with SC and in the meantime you will be paying them £xx a month. Don't just drop of their radar, keep some sort of communication channels open. You should probably expect a flurry of letters and possibly phone calls from creditors at this stage, just par for the course I'm afraid. You should tell the callers that you request all future communication in writing only, not by phone (if that's what you want, like most of us).0 -
I just wanted to say reading this forum makes me feel much calmer about my situation.
We've taken the first steps and contacted our creditors last month to say we were going to go in to a DMP with SC. We thought we would start our DMP in August which would of been, 2 months from contacting creditors however I would prefer to start in September allowing 2 months to put some money aside. Is 3 months too long. Do we write again to creditors explaining this?0 -

You cannot CCA overdrafts as different rules apply, but nothing to stop you sending one for the credit card.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Do whatever you are comfortable with, does no harm keeping in touch with your creditors, just be truthful if they ask why.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Looking for some advise regarding a payday loan I have with Mr lender. I took the loan out approximately last summer, logged a complaint for irresponsible lending and the outcome of that was that they agreed to keep the amount outstanding the amount borrowed £500 minus any payments made, I escalated the complaint to FOS and they agreed with the resolution mr lender offered which was fine.
November last year went in to a DMP with stepchange and maintained payments with them.
Last month went self managed and they wouldn!!!8217;t accept my offer unless I went through an I&E with them so nothing has happened since.
Couple days ago offered a full and final which they refused but they confirmed They!!!8217;d accept £340, my balance should have been £380 based on what was offered in regards to the complaint and payments made, also at the time of the complaint it stated my financial situation re DMP and obv making less than the contracted payment.
Today I!!!8217;ve teceived a default letter stating my balance is £880 so I emailed them back to the original email asking for bank details of how I could pay the £340 figure to which a reply stated my balance was £700 (different to the default notice).
1. If they have agreed this in a complaint can they now backtrack the offer
2. Why has it taken them so long to default me....nearly a year
3. Why are they providing different figures
4. Do I have a leg to stand on as it seems so wrong with what they are doing
Thank you0 -
