The new owner of the debt will usually have to request the original paperwork/records from the original creditor. I think I've read on here somewhere that the new owners of debts are not always aware of the enforceability or otherwise of debts. They just tend to bulk-buy a whole batch of debts at a time.
Happy to be corrected if I've misunderstood.
Not sure I do think it’s a good idea as such, it just seems the collection agencies seem much more willing to offer an opinion and I guess once you have that in writing from them it’s a definite no further (legal) action. UE does seem to be a finger crossing exercise and hope for the best.0 -

That is true to a certain extent, Lowell bought one of my debts, they could not produce a credit agreement for the account, from the OC, could of been because i never signed one (Catalogues didn't bother with the niceties of paperwork back in the day).
Anyway they wrote off the debt straight away as they knew they didn't have a leg to stand on, others are not so compliant, and try to bluff there way through it.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Another quick self managed question - did you enclose details of the outstanding debts/creditors to all of the creditors involved or just an income and expenditure statement detailing the amount left over after bills etc that would be split between creditors?
Hope that makes sense!!

This probably would have been the best place to post my problem - does anyone know if StepChange would allow me to delay my DMP for a few months to enable me to move house? I’m relocating for lower living costs which will ultimately allow me to pay more towards my debts. But there are various costs associated with moving, including potentially requiring temporary accommodation/moving van/deposit for new place which I’ll need to have more towards.0

It's your plan, not theirs. Start when you're ready.0 -
Thanks, thought someone might say that. I guess I’m just a little concerned that I’ll start getting harassed by the creditors that haven’t sold my debts on yet. I’ll try and ring them all and let them know I can start paying in August when I’ve got myself moved and into my new office (I have been approved for a move to the region I want to be in but no specifics on where i’ll be yet).0

Keeping the creditors up to date is 90% of the battle.
As long as you tell them your plans, most will be sensible about things.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I sent I&E statement together with list of debts and breakdown of payment amounts offered to all my creditors - so they each saw what was being offered to other creditors. That was what was generated by NEDCAB so that's what I sent.DFW Nerd No. 1484 LBM 07/01/15 Debt was £95k  Now debt free and happy :j0 -

When I went self-managed each creditor sent me their own version of an I&E form to fill in after I'd notified them I was doing it. I'd already sent them a simplified I&E when I wrote to them:(. Real nuisance as the creditors' forms were all slightly different and wanted the info in different formats:mad:. I think they all had a section asking for all other creditors, balances owed and payment amount to be listed though.0 -
I'm on a DMP. Just started and will make a payment this month my first payment. My question is...
Has anyone dealt with drafty?! Obviously haven't paid this month. I've emailed wrote and rang to explain my situation. I have currently 26 emails 15 text messages and 7 missed called in 48 hours.
I want them to leave me alone!! Seriously considering changing my number.
That sounds rather extreme!, have they stopped contacting you ? I have £3000 debt with drafty but I am waiting for something to sell and then I'm hoping to pay them so I dont have to include them in the dmp as I had not heard of anyone having any experience with them so was worried what they would be like.0
