    Hey guys. :)

Does anyone have any experience dealing with Moorcroft? My Vanquis account was sold to them a few months ago.

My GP has suggested that I try to get my debt written off due to my health which isn't going to get better (and my mental breakdown at the time of obtaining credit.)

I sent a letter with my I&E and medical evidence and advised that if they do not accept my request to write off the debt then I will be paying a token payment of £1 a month and requested their bank details to set up a SO if this was the case.

Today Moorcroft sent my documentation back with a covering letter saying that they will be actioning my account accordingly and they may be in touch again.

They didn't send me their bank details and they also didn't saying what "action" they would be taking on my account.

Should I try to clarify with them or wait until they maybe get back in touch?

    Thanks.

From personal experience Moorcroft are very helpful. Do Moorcroft own the debt? For the debts that we deal with Moorcroft for, they are just agents collecting or managing the debt for the owner. Our debts moved from the original creditor to a debt collection agency DCA, and that DCA has Moorcroft collecting the debt for them. A bit long-winded in my opinion.

Anyway - find out who actually owns the debt and send your letter and medical info to them. Moorcroft should pass it to the owner, if it's not them, but I would send it direct anyway.

    .......
Here's why I've stopped myself: I've been "coping" with minimum repayments....just.
But I also have a boyfriend (he's German) who is doing a masters course for the next year and a half. After that I don't know what is going to happen-whether he will try and find a job here or whether I will sell up and move with him somewhere else. I'm hesitating about starting a DMP because I know I won't be able to get a mortgage again. I'm also worried that if I stay put, when my mortgage deal is up for review, they won't offer me a new one and I'll be stuck on an unpredictable interest rate.Any advice?!

Whether you choose to continue just 'coping' or enter into the DMP world is really a personal choice. It will impact on your credit file, yes - but that doesn't necessary mean you wouldn't be able to renew/remortgage if you stayed with your current provider. Others have successfully renewed onto fixed term deals whilst in a DMP.

If you haven't already done so - my advice would be to use the SC online debt remedy tool and see where you stand first, then consider your options. You might also want to search online for one of the credit card repayment calculators -I think you'll get quite a shock in terms of the number of years a £19K debt would take to clear if paying only the minimum.

Hello to all the newbies :) not a lot to update from me, just continuing to pay creditors £1 a month and saving money.

NEXT have moved my debt over to their ‘in house’ debt recovery company Brecon, however completely dismissed my CCA request. So when Brecon emailed me to set up a plan I kindly reminded them that NEXT have yet to send me a CCA but I’ll set up £1 a month as previously advised and they didn’t reply. Surely it won’t be hard for them to ‘reconstitute’ an agreement for 2013? Unless they just didn’t want the hassle.

I wouldn't pay anything until Next produce the CCA - I would write and tell them that (as you have just communicated anyway) and then not communicate with them any further until such time as compliant CCA provided. The clock starts ticking on statute barred - yes, it takes 6 years, but you never know your luck and some of these companies are absolutely useless. I am almost 2 years in on a CCA request which has not been supplied. A third of the way towards statute barred :j

"Statute barred debt refers to a debt that's not enforceable because the time a creditor has to chase payment has passed. This is outlined under the Limitation Act 1980."

In England debts become unenforceable after a period of 6 years from the last written acknowledgement or payment (12 years for mortgage debts).

Although a debt may become unenforceable, it is still 'owed' - but no-one can force it to be paid, not even the courts.

Edit: If a CCJ has been issued before the 6 year limitation, then the debt is enforceable and there are no limits of time to enforce a CCJ

Interesting, I didn't know that. I presume it still stays on your credit file though?

Yes, it will stay on your credit file. However, it will either already be defaulted, or will quickly be defaulted if you are not making payments and therefore it will disappear from credit files after 6 years anyway :j

Ahha.....so as all but one of our debts are already defaulted:T, even if we went down this route, it would fall off the credit file after the 6 years from default? So there is no way they can then suddenly come back at a later date and make you pay? Or no way anyone else would know as it is off your credit file?

I have the CAA letters ready to go, just got to get the PO's tomorrow. But didn't understand exactly how it worked if they can't produce documents.

Any experience of what BC are like at coming up with the documents? Already been sent to DCA's but they are our biggest debts. Would be nice to see the back of those.
