Sorry. My fault. I meant appeal rather than MR. I'll change my post now. Still 30 days though!

As far as I am aware you can't now get the ESA from January. Someone better versed may know different but I suspect that the answer is you could have claimed JSA

ESA is put back into payment at assessment rate from the date of the ESA dis allowance i.e. from the date ESA was stopped.

'IF' you have claimed any other benefit the amount you've received will be deducted from that payment.

For that to happen you need valid fit notes for the whole period and for the Tribunal Service to have accepted your appeal and notified the DWP of this.

I wrote a letter asking for payment of ESA assessment rate enclosing my fit notes and a copy of the Tribunal letter accepting my appeal - took 2 weeks or so for the money to hit my account.

Thanks for this update and information. Appreciated!
  • Thanks for that information Speedfreek, it is appreciated.

As I have only sent in a fit from March 22 and haven't had one before this period of time (even though I was never informed of this information, let alone considered it as the people on the phone constantly told me to apply for JSA and was in no fit state to do that back then, let alone now) I don't believe I can ask the doctor to backdate fit notes, can I?

I read somewhere that this can be seen as fraudulent and a malpractice and I don't want to get the GP into trouble, let alone myself, so it would interesting to hear some further information on this (I usually see the GP within a time frame of a fortnight to a month anyway, but never considered doing what you suggested as I was so focused on trying to attend my other appointments and getting through day by day grief at the same time (considering my Grandmother was staying with us throughout her whole treatment for Lung Cancer and she passed away in the front room, as you can imagine I was struggling back then and even more so now).

I am just keeping busy collecting the medical evidence now as well as writing a letter about my day to day life, how all of my ailments affect me, what I used to get around and everything else Alice linked me to, which was another great help.

    One day at a time.

If you have seen the doctor during the time period that you need fit notes for then it is worthwhile asking for backdated fit notes.

From what I have heard/read it seems that some doctors are willing to do this if the patient has an ongoing medical condition which makes them unfit for work, or they can verify their inability to work because they have seen the patient during the time period.

Nothing to lose by asking your doctor.
