CMS and now ZZPS Parking Notice on landowner car park

Hi,
I will try to keep this short and sweet.
I own a flat that comes with parking space (for 15+ years) and have a valid parking permit. Landowner is ASRA housing group. CMS monitor the car park, received PCN one day after my permit fell off after cleaning dashboard.
What would be my best course of action from here?

- 12/01/17 PCN on car
- 01/02/17 I contact ASRA (face-to-face) who agreed to cancel ticket, have an email to confirm this from ASRA
- 27/02/17 Receive NTK letter from CMS. ASRA confirmed have tried to contact CMS but not had reply
- 02/03/17 I forward email from ASRA to CMS (appeals@iPaymyPCN.net)
- 08/03/17 Receive email from ZZPS saying they pursuing on CMS behalf and not received instruction to cancel. I forward email to ASRA and check they have cancelled PCN
- 23/03/17 Receive letter from ZZPS about unpaid PCN, checked again with ASRA who said (in email) they tried to cancel but CMS refused to cancel
What would be my best course of action from here?

Should I respond to ZZPS to say that I've been waiting for the landowner to cancel the ticket and have only just found out that CMS refused their request to cancel it. I have nothing to add as I do not owe anything to CMS as the purchase of my flat includes a parking space written in the terms of agreement.
Or should I respond with a BPA appeal template letter?0 -

1. Demand to know when ASRA are ending this unworkable contract with this notorious ex-clamper. Contact other residents and if you have a Residents' Association, call for an EGM to kick the useless thugs out. You DO NOT need permits!

THEY CAN'T DO THIS TO YOU AFTER 15 YEARS.
2. Ignore ZZPS. Never ring or write or engage with a debt collector. Laugh at their letters.
3. Ignore a Wright Hassall letter if it asks for payment to ZZPS (that letter comes from ZZPS too).
4. Tell ASRA you opt out of the permit scheme, never accepted it and hold them liable for derogation from grant, should CMS try a small claim.

Just an update on this, as it is now resolved.
- The ASRA officer I'd been in contact with had left the organisation
- I put a complaint in to ASRA housing to say the issue with parking still remains and needs to be resolved
- Complaint returns saying it's my responsibility and due to over 28 days they cannot do anything about
- I progress the Complaints to stage 1, saying not my responsibility as ASRA officer said she'd cancel it and also that CMS were not protecting the residents as they did not accept the appeal.
- Complaint got upheld, so they agreed to reimburse me the parking charge, I pay the parking charge just had to send ASRA the receipts.
- ASRA have now paid me back the money I paid for the parking charge (including the credit card fee).0 -
Forgot to add that I had email proof that the ASRA officer would get the ticket cancelled.
Also now, there has been a letter to all residents that CMS will no longer be responsible for monitoring the car park0 -
Now bill the HA for your time and threaten the PPC with a data breach case. Whether you follow through or not, it all costs them money.You never know how far you can go until you go too far.0

I liked reading that - a good result (shame you actually had to pay them so they got money - albeit not yours).

CMS have been issuing ‘Parking Charge Notices’ from an Address which they no longer occupy. The address which their company is registered to, ‘55 St Leonards Road West, Lytham, St Annes, Lancashire, Fy8 2PF’. This would mean that their company is operating illegally. CMS moved out of their address in January 2018, yet failed to inform ‘Companies House and HMRC in February 2019, when they submitted a signed ‘Conformation Statement’ (previously an Annual Return), to report no changed to the running of their company.
These are google map images that proves that ‘Harpers and Co.’ a Funeral Directors occupied ’55 Leonards Road West’ in August 2018.0
