PPI After the event?

Hi all,
I'm currently chasing up some old PPI claims with the help of this site, so far quite successful.

I'm claiming PPI was missold in that I did become unwell and was unable to make payments...and the very first thing my credit cards did was cancelled the policy rendering it not fit for purpose.

I've just heard back from HBOS regards a card I opened in 2000, I became I'll and unfit for work in 2004 and the account fell into arrears because they wouldn't activate the PPI. HBOS are now claiming that though I opened the credit card in 2000 it wasn't until june 2005 that they sold me the PPI Policy, which they then cancelled in January 2006.

I know they're just trying it on but surely claiming to have sold a policy on an account that was in arrears to somebody who was unemployed is much worse than just bog standard misselling?

Has anyone else had any claim from a company that the policy was sold so many years after the product?

    Do you have any evidence you can show HBOS complaints team of paying PPI premiums prior to June 2005?
  • I've sent a SAR request for copies of my statements and other information they hold since by the content of the phone call they seem to have access to old records from 17 years ago still

    Depends....

    Either you were ill and the PPI was erroneously not activated, or you had an illness that wasn't covered by PPI.

    The easiiest way to see whether you paid it when you opened it is to send a SAR and £10 to see if it's on the statements from then. [Don't ask for statements, ask for all info they hold on you] If the info still exists, you'll be able to see it. If the ifo doesn't exist, [and you don't have this info either, HBOS are only obliged to keep it as long as necessary, a recommended 6 years] then you're stuck with HBOS version of events.
