    I think people's responses assume you are in England or Wales.

    The legal situation might be different if you are in Scotland.

    Op I am so sorry. But there is nothing you can do. But the good news is that you have everything ready so that the next time you see a house you can move quickly.

    Don't forget just as you can pull out at anytime before exchange so can they. I know that this is heart breaking but it happens.

    That's the purpose of the reservation fee.. to secure the price and your position as the buyer. You wanted the flexibility of not losing out if you couldn't get a mortgage / Help to Buy, but you expect the builders to be locked into a particular price and buyer..

    You haven't reserved that price until you've paid the reservation fee!
