Another APCOA PCN - question

Amended on advice!

If a car with a valid parking ticket parked in error in a staff parking area of a railway station car park, (which could be more clearly indicated) would this still fall within the by-law rules enabling a PCN to be challenged. Or is this area seen to be different to the main car park?

    IGNORE has not been recommended on here for 4.5 years !!!

    people should ALWAYS appeal to a PPC at some point if a pcn has been received

    the NEWBIES sticky thread says when this should be

    but railway land is covered by bylaws and so its a bit more complicated

    and only a fool posts on what they may have done on a public forum , so the words "me myself and I" are banned , replace any details with THE DRIVER or THE KEEPER ;)

    It is not a fine.

    Since it was not obvious where the staff parking area started/ended then the signs were obviously inadequate. This would be one of several appeal points at PoPLA, probably the strongest point being that byelaws apply so the car park is not relevant land as far as the POFA 2012 is concerned.

    You should also edit your post and remove the bit about where the car was parked (first part of the second paragraph) within the car park. Never give the scammers any help that could be construed as an admission of guilt.

    I have read through the Newbies bit a few times now and although the inference is that I would probably win my appeal it does all look a bit scary for someone that hasn't done it before.

    so dont bother with those questions , just follow the party line

    blue text appeal to apcoa (with a free certificate of posting from the P.O. Counter if sending it by royal mail

    then use a recent ( so only from 2016 or 2017) "railways" type of popla appeal, majoring on bylaws applying , non-relevant land under POFA2012, poor or inadequate signage etc for popla later on down the track when submitting the "raliways" appeal to popla

    any other issues are not needed to be dealt with or answered at this stage

    so tried and tested method, no going off the well trodden path

    I have read something somewhere about POPLA reviewing the byelaw part and whether they could rule on them. Will this have any effect on these appeals?

    PoPLA should be allowing every appeal where byelaws apply. On eof the regulars has posted the relevant information but I neglected to bookmark it.

    Basically, do a good PoPLA appeal, ensuring byelaws is your first appeal point, and you should win.

    Make sue you post up your draft here for checking first. Use the template appeal points in post 3 of the NEWBIES as your starting point.
