Getting my deposit back...What would you do?

I'm anticipating trouble.
Here's the situation. I found a place on spareroom and was told the existing sharers were moving out on my moving in day. So fast forward to moving day. The sharers are still in the house to my frustration. I honestly don't feel as if was being mislead as the existing sharers seemed obviously pretty seriously about shifting out.
So I've decided to give it a week. Weeks now up and there's no sign that they're budging.
I'd love to get my deposit back and make a B line to the nearest B&B. But I suspect the LL is going to be a pain about it.
In terms of my rights, there's a crudely written agreement. The LL never got around to signing. Although the deposit was taken in cash, I've gotten him to confirm that he received it via text.
So let's assume the LL says nope you had to give me a months notice I'm keeping your deposit, what would you do? I'm even thinking of doing a sit in if I had to!

google landlord not protecting deposit in a deposit protection service. i found a template letter which got my deposit back almost immediately.
i then reported them to the government for not declaring income. i assume not protecting the deposit was a way of not trying to flag up they are letting a property out0 -
1) what do you mean 'deposit'? A holding deposit? A down-payment on rent? Or a security deposit against damage?
2) do you have anything in writing stating the start date of your contract?0
