I recently bought some perfume from PerfumeCare. When it arrived and I checked the manufacture date, the perfume was nine years old, which I consider unacceptable. To date the Company has not responded to my emails. Any suggestions, please.

    Did you pay in person or online? How much was it and how did you pay? How long have you waited for a response to your emails?

  • The cost in total was £46 and I paid via Paypal.

    As you paid by Paypal the easiest option is to use their dispute process.

    Log into Paypal and click into the resolution centre. You have 180 days from purchase to open a claim.

    The claim you want is SNAD (significantly not as described).

    Open the claim, state the perfume details including the date - don't waffle too much - upload a photo of the date on the box if you can.

    Paypal will give the seller some time to respond. When you can, you should escalate the case. Paypal will review it. As long as you have explained the item you had received is different to the one you had purchased you will win the case.

    Paypal will tell you to send the item back. Now here is where you may have issues.

    Firstly you have to send it back using a trackable method which is viewable online. Secondly, this will be at your cost although you may be eligible for a Paypal returns refund https://www.paypal.com/uk/webapps/mpp/refunded-returns. Thirdly not all carriers allow perfume to be carried.

    What size is the perfume and what type (ie EDT).

    Have a read of Royal Mail's restricted/prohibited goods. The BEST method to return it (assuming it isn't restricted/prohibited) is via Special Delivery. Don't be tempted to use Signed For.

    Perfumes and aftershaves
    Including eau de parfum, eau de toilette and alcohol-free perfumes, but excluding non-flammable perfumed creams, gels, oils or lotions.

    Volume per item must not exceed 150ml. No more than four perfumes or aftershaves can be sent in any one package. The perfume or aftershave must be within its original retail packaging and then placed in strong outer packaging. The inner packagings must be packed, secured or cushioned to prevent breakage or leakage of their contents into the outer packaging.

    An ID8000 label must be applied ( see example ID8000 label Opens in new window ). The sender’s name and return address must be clearly visible on the outer packaging.
    These items must be presented at a Post Office® counter.

    Did the item offered for sale specify the manufacturing date? If not then it wasn't mis-described and a Paypal claim under SNAD may fail.

    To help your claim you may need to provide supporting evidence, such as guidelines on the oldest age that perfume should be sold (if such guidelines exist).

    I have just had a look at the website. It doesn't actually state they are selling new perfumes and some of the detail is ambiguous.
    This product was added to our catalog on Thursday 19 February, 2009.
    . There doesn't seem to be adequate description on any of the perfumes I clicked into.

    They may argue that the [old] date isn't sufficient to claim a SNAD. Paypal may agree. Is the perfume you purchased still on the site, if so, which one is it and what did the description actually say?

  • I have managed to get hold of someone on the phone and they have now agreed to make a refund, although they dispute that the perfume is 'out of date', claiming that it has been stored under good conditions. I am not so sure that they could verify that.
