@CM66 - That was my understanding too, as well as some of my lawyer friends. I was expecting the loss of the deposit to be honest and would have paid it (maybe kick up a small fuss to try and get some money back - but ultimately i would have been ok with that)

Jesus, hope I someday end up in a position where I can just throw a grand down the drain willy nilly! :rotfl: I might not even kick up a fuss at all ;)

I suspect when you've ended up cancelling a wedding, the financial hit is somewhat overshadowed by the emotional aspect.

I'm sure the OP is all over the place emotionally given the circumstances..but do you really think that that response helps them?

You only get a cooling-off period for "distance contracts". As you paid the deposit at the venue, this was not a "distance contract" so I don't think you have any cooling off period.

So I think the mention of a cooling off period in previous posts is a bit of a red herring.

Whether you are liable for the additional £3.5k or not depends on whether the payment of a deposit was (1) simply to reserve the slot, or (2) whether payment of the deposit meant that you had actually confirmed a booking. You need to be clear that it was only (1) that was agreed.

As others have pointed out, you can't be held liable for anything under a set of T&Cs you weren't provided with at the time.

At this stage I think you should make it clear to the venue in writing (letter or email) that you never received the T&Cs so are not bound by them, and make it clear that you will not be paying anything extra.

So I think the mention of a cooling off period in previous posts is a bit of a red herring.

While OP did say she attended an open day (so possibly is classed as off-premises contract rather than distance contract) she also said she paid the deposit over the phone. Not quite sure where you've gotten that she paid it at the venue.

However, wedding venues are considered leisure services and attract no cooling off period if the services are to be performed on a specific date/s. They still need to comply with the rest of the CCRs but the section giving the right to cancel does not apply.

But its still misleading to say "you only get a cooling off period for distance contracts" because that quite simply is not the case. There are a range of instances where a cooling off period is mandatory, there are also instances where a cooling off period may be required in order to achieve contractual fairness is the contract is particularly lengthy or complex.

    This
1k is a lot, not really money i Have to waste.
My short term concern has been trying to 1.)salvage the remains of what could have been my wedding (issue wasnt between me and bride - more between the families which escalated tremendously)
2.) not paying an extra 3.5k which i wasn't aware of. Luckily we didnt book much else.

At least 2. has been sorted somewhat! :money:

Solution for number 1....elope and dont invite either side of the family!

On a more serious note, hope it works out well for you both.

Ahhh!! My apologies to the OP then! I was under the impression that they were simply changing the venue.
