travelodge cancellation

booked a room, with wi-fi add-on - fully flexible and refundable. Just cancelled and the wi-fi is claimed not to be refundable because. according to the Ts & Cs
"6. Food & beverage Extras are refundable in accordance with these terms only. All other Extras, including but not limited to wifi, are non-refundable at any time. Please note that wifi costs are fixed by our wifi provider and will not be refunded by our wifi provider. "
Can they do that? (a) I have ordered a service, by distance selling, that has not yet commenced (and won't for 10 days now) and (b) contract is with them, not their provider.

To answer your points:
(a) Hotel bookings aren't covered by the CCRs. Therefore you have been able to cancel by the company cancellation policy rather than by your legal rights. I suppose it comes down to whether the wi-fi is classed as part of the hotel booking or a seperate purchase.
(b) You are correct, but it's immaterial really on the face of it as it is Travelodge denying you a refund, not the wi-fi provider.0 -

Hotel bookings are covered by CCRs - its just exempt from part 3 (right to cancel) providing its to be provided within a specific date range. Unless it was a package holiday falling within the scope of Council Directive 90/314/EEC.
I obviously can't say with certainty one way or another, but the CCR guidance makes reference to a dishwasher that was supplied & installed. It says they would be able to cancel the dishwasher, but not the installation (provided they were informed they would have to pay) as the service has been completed. So each part of the contract in that instance does have separate cancellation rights . The CCRs themselves have paragraphs/sections which may not apply to the main obligation due to exemption but will apply to other work agreed.
So imo its possible cancellation rights should apply to the wifi.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
