PCNs... Thank you Martin Lewis
I downloaded a template and adapted it a little to my circumstances and within 48 hours the Civil Enforcement Ltd 'phone to pay' company cancelled my charge they had sent me.
It was for a 'wait' of just over 12 minutes on a private piece of land (in Stroud, Glos) that did indeed have signs up about the hourly parking charge to be paid on card by phone. I was not parked, but waiting for my 11 year old step son to pop into mcdonalds on a sunday... I did not leave the car and waited with the engine running. When I drove up to the signage about the parking I realised that I couldn't pay as I had left my phone at home and felt it inappropriate to move elsewhere as my step son would not be able to locate me.
I stated this as mitigating circumstances and kept the paragraph in the 'template' letter about disproportionate charges.... being 75pence per hour and if £60 not paid within 14 days, it would increase to £100. Even though 28 days was given to appeal. But if appeal was turned down by the company and went further, £100 plus costs would be incurred. If disputed, who knows.... and all for a WAIT of just over 12 mins
The template gave me the basis to word things in an assertive, direct and professional way which I think I would otherwise have struggled with as my emotions were running high and felt I was being treated unfairly for a law abiding member of the general public that just made a simple mistake.
Hooray for Martin. It worked and I'm now left feeling that a lot of private parking security companies who are legitimately registered, just try it on.. I believe that a vast amount of people pay these 'invoices' (not official fines) because they are worried about further charges etc
