I think everyone finds this stage difficult, and you are doing brilliantly! We have just been busy and 4 out of 4 court claims at small claims yesterday were won here by posters.

Give us a chance - unfortunately this week, your thread keeps getting knocked to page two by newbies wasting our time with debt collector queries, etc.

Keep replying when you want help, tell us what your specific worries are. We will look and we will help.

4 out of 4 claims won this week!? That is awesome. Congrats to all, and to all those that helped them! :)

My question is, I wish to reference the Beavis case (as is in the template), but to make it relevant to now as the case has concluded. I've posted on #61 of the options that may be relevant.

    Cheers guys

Does the PoFA apply to my case if it is residents parking (of where I was a resident at the time)
    Parts 4 to 9?

    Of course it does.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Why should anyone want to reference Beavis in an "own space" situation? They have nothing in common?
You never know how far you can go until you go too far.

Can you suggest other cases to reference for evidence?
It is regarding residential parking rather than own space. There weren't allocated spaces. They had my details on file (as residents cars had to be to obtain a permit). Yet they still obtained keeper details from DVLA.
Maybe Jopson v Homeguard, Pace recovery and Storage v Mr N, UKPC v Mr Aziz, Saeed v Plustrad Ltd, Link Parking v Mrs P, Vidal Hall v Google Inc (DPA), Halliday v Creation Consumer Finance Ltd (DPA)?

    Thanks in advance

Because the other side will, and will paint it as case law for all private parking cases, and some Judges would (and do) still fall for that.

Yes, although I can't recall UKPC v Aziz
Vidal Hall v Google Inc (DPA), Halliday v Creation Consumer Finance Ltd (DPA)?
Yes, in a robust counter-claim for DPA misuse of data.
