I did not appeal to IAS as the form required disclosing the driver :( well now any how can't go back to appeal. Will await correspondence from UCS (Ultimate Customer Solutions) the debt collectors.
Complain to the DVLA about that. It is not allowed.

Send an email complaint to David Durnford at the DVLA. I think his email address is in the NEWBIES.

Below is the reply from DVLA, seems they agree with IAS asking to reveal the driver details

Thank you for your email regarding the appeals service and the information it is requesting.

While it is not in DVLA’s remit to comment on the IAS it is reasonable that they are made aware of the capacity in which you are appealing i.e. as the driver/keeper/third party as this may help with their decision on whether to uphold or reject the appeal.

From the screenshot you have provided, I cannot see that they are insisting on the driver being named, only a question as to whether you (the appellant) are the driver. I should also mention that DVLA provides the vehicle keeper details to private parking companies to initially try and identify the driver. It is the choice of the keeper whether to name the driver or not.

If you have any concerns with this appeals process, you should raise this with the International Parking Community who are the Accredited Trade Association for this parking company.

I hope this information assists with your enquiries.

    Hi Forum,
Today received a letter from the solicitor advising to pay £160 and avoid being taken to county court.
    Solicitor letter

Should I respond to the letter or ignore and wait for them to take next step?

Just thinking from worst case scenario, as mentioned in the letter if the court decision goes against me will it affect my credit rating?

    Thankyou,
    San
  • 1. For your own security, best you delete your name and drivers reg. Number from the letter.
    2. It is likely this template letter has never seen a solicitor. Note payment is requested to a third party and there is emphasis on MAY take legal action. If they really mean it, you'll get an unequivocal letter of claim

agreed, it is a UCS debt collector letter on solicitor headed notepaper

if you lost in court and had to pay £160 , then pay it , promptly , within 28 days

it is NOT PAYING THE COURT JUDGMENT that leads to a CCJ and issues with your credit rating

so if you lose , pay up
  • In the worst case scenario and the Court did find against you, prompt payment (which you could make at court directly over the court counter, before leaving - were you so inclined) would ensure there was nothing on your credit file.

A CCJ registration only occurs for unsatisfied court debts. At the moment, the PCN is nothing more than an invoice.
