Car Insurance Problem

Hi, I've been having some problems with my car insurance and need some help.
I was involved in a car accident last December and the other party admitted liability. The car was sent to an approved repairer, the repairer however, only repaired part of the car. I complained to Privilege and they stated that the damage i wanted repaired was from a previous repair (i bought the car privately and wasn't aware that it had been repaired before until this accident) and they weren't going to do it. We took them to the FSA and proved that the damage was as a result of this accident (had reports from the garage where car was serviced and another independent report), the FSA sided with us and ordered the damage to be repaired.
Now today the claims guy came to have a look at the car and stated that because the panel has been repaired before they can not guarantee any work done, he also stated that had the damage been included in the original repair they more than likely would have written off the car. They are not willing to replace the quarter panel and door.
Has anyone been in this sort of situation before? Surely if it was the other motorists fault, no matter what the cost i should have my car repaired to the standard it was before the accident regardless of whether the car has been in a previous accident or not. What really gets me is that this car should have been written off in the first place but Privilege tried to cut corners and now I'm stuck with a car which will never be repaired properly!!

If they cannot guarantee any work done hen they need to replace the parets rather than repair.
The fact that they would have written it off is THEIR problem.
They have been ordered by the FSA to do this.
Have you got the FSA involved.
Get the involved.
I don't know if they have any teeth.
If it turns out they have no teeth then you may have to take the insurance company to court but with the FSA on your side I wouold say you have a good chance.
My advice would be to
1) Try and see what the FSA can do.
2) If the FSA cannot force them then take it through the small claims court. Write to them by recorded delivery and tell them to agree to fix it withing 30 days otherwise you are going to court with the ruling from the FSA.
I'm afraid I don't know if the FSA can force them.0
