Speeding ticket with tampered vehicle sheet!

I work as a delivery driver and was called into a investigation today for a speeding ticket, which happened on the 21st Feb.

My boss who was conducting the investigation pulled out my vehicle check sheet, which is a legal document. To my surprise it had been tampered with and the reg had been crossed out and changed to the vehicle which had been caught on camera!

I questioned this and my boss came up with, I must have put the wrong reg in when checking the vehicle so the supervisor would have changed it.

My boss then checked to see if I had clocked in that day, which I had. She then checked the running sheet for the 21st, which states what delivery addresses I would have had for that day. She compared the speed camera time to each delivery to see if I was in the same area, which I was.

The company has 20 plus delivery vans, which cover the same areas everyday. There will be several vans going through the same area throughout the same day continuously. The running sheet just states I was in the area at the time of the offence, not what van I was in.

My boss has already sent my details to the police, which I feel is wrong because she should be investigating why this vehicle check sheet has been tampered with and finding out who was actually driving the van before sending anyones details.

What am I best to do now ? I'm not sure if it was me driving that van but from what I wrote on that sheet, I checked and signed for a different van entirely and there's is no proof of me driving the van, which went through the speed camera.

I have my investigation being continued tomorrow and waiting for the speeding ticket to be posted. I remember seeing the letter the police sent the company being the 8th March, would this mean it's within the 14 days ?

Any help and advice is appreciated

Regardless of tampering, you just said you were in that area on that day.........

I can't work out if your trying to worm out of this, or if you genuinely believe it was not you.

I am more than willing to own up if it was me, but how can I do that when the vehicle I had checked and signed for was different ? Surely no one is going to admit liability when the vehicle sheet has been tampered with.

Ok, well I admit I don't know how this clearly very poorly implemented system works, but would there not be another sheet from the same some of time, where the details had also been tampered with?

Also, are there any drivers that might have been driving that day, who are perhaps related to or good friends with someone who might have access to tamper with the records?

you need to find the running sheet for the original reg you wrote on the sheet to see if that has been tampered with as well

Can you read the crossed out reg? If so, you need to find out who was driving that van and how that checks out.

Clearly the OP was driving the van with the crossed out reg the important thing is who was driving the van of the new reg as the OP thinks he is being strung up for a speeding ticket someone else got in the new reg van. Possibly the van was not being used for deliveries that day and instead a manager or director was using it for non company related use which would mean it was not insured.

Dippa I would raise a grievance with HR about your manager if you truly believe you are being stitched up, and then look for a new job, or start taking photos of your signed sheet with the reg beside it every day as evidence you were driving van x on day y if this ever happens again.

There is not a shred of evidence to suggest that. How does such fanciful speculation help the OP?

When you receive the notice of intended prosecution, ask if there is any photographic evidence as you have reason to doubt that you were driving. If it gets to court, you could enter the check sheet into evidence. I assume you signed this sheet when you took this van out and the reg was changed subsequent to this?

Interesting case, I'd be interested in how this turns out, so please keep us updated.
  • If a legal document has been amended after you have signed it surely that is against the law? Are you a member of a trade union? I'm sure they would be interested to hear.

Surely if the OP signed for a different vehicle then there would be a different driver against that VRN or there would be 1 van less?
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
