might not be gala bingo, might be Tiger or Optic Assets, see my last post above yours

when the person I know had a pcn there they were BPA members and that person won at popla , so we got the contract and as you can see it expired a few years ago, or was extended or renewed , so all irrelevant now as to what happened years ago (but the landowner details may be the same now)

if you have notified them of the drivers details then they should not be writing to you , if they are you inform them that the driver has already been identified and to stop writing to YOU

if they are writing to your girlfriend then this has nothing at all to do with you as you have named the driver, they cannot pursue both parties (although they may try to do so, or to sc@m both of you, which DRP do daily) , so if the girlfriend is receiving the letters then SHE should be dealing with this, not you (even if that means ignoring DRP)

watch out for any postal letters from either EXCEL or from B W LEGAL, come back if anyone gets those, and be specific about who gets what from where (this is nowhere near any court yet)

    I don't think so!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I've emailed the gym to ask who he landowner is. They must know who owns the car park. It's more than likely the same company that owns the land the gym is on I'd have thought. I've also requested the copy of my girlfriends attendance at the gym that day as proof and asked if they can contact the landowner directly. They're far more likely to hold clout with them as they're a direct client.

There's been one letter from excel to myself. Then the same initial PCN to my girlfriend and then a 'final reminder' from them followed by the DRP.
If I say 'we/us' I mean my girlfriend and I. If she's going to court I see it as 'us'.

    You've been a big help.

the GYM may rent from an M.A. , so may not know the landowners details , so you may wel be wrong there , it is unlikely that they rent from the landowner direct and so I doubt that they actually know who the landholder is

you need to use the words ME or MY GIRLFRIEND , not "us" , there is no "us" in a legal case, especially if an MCOL arrives from Northampton, it will have a persons name on it (the defendant) , so again , there will be no "us" , nothing to do with you if "she" receives court papers

and yes I am aware "US" is used up here a lot as I am from the same area as you probably realise (which is TAMESIDE, not Manchester)

so if either of you get more correspondence , be SPECIFIC in who has received it, and from who and where too

and EXCEL most definitely take people to court , especially since the BEAVIS case ended 16 months ago , so it may well happen

The Land Registry only charge £3 for the document showing who owns the land, and £3 for the plan if you want the plan as well.

Keep pressurising the gym, can't they write to Excel if they are losing customers or at risk of losing customers? and same pressure on Gala but they may not care as you aren't a customer of theirs.

PPC/its dogs will be writing to your gf now, not you, as you've told them she was the driver. So this isn't your problem, it's hers (although obviously you're going to help her). Any proceedings will be issued against her, not you.

Or are they writing to you? If so, tell them to bog off as you've already given them the driver details.

LOC has already told you that you can get the landowner details for £3 so you don't need to be faffing about emailing the gym who probably don't even have a direct relationship with the LO; and if they do may not tell you

Even if you send proof that your gf was genuinely using the gym Excel won't cancel the PCN because they'll say she breached the T&Cs by not entering her reg

Write to all retail outlets on the site complaining and withdrawing your business. If they have Facebook of Twitter pages write bad stuff on them.

Sooner or later they will get the message, predatory companies like this add nothing to the bottom line.

    Yes they will.

scotty12348 should click on Lamilad's username and read his threads. Lamilad beat Excel twice with two sucker punches, one in November and one last month. And I think only one poster here has lost v Excel because BW Legal evidence is so useless!

Hi - I am in the same situation as you

I believe the landowner for the carpark is Harbart Management Corporation and the assest manager is CBRE Ltd

You can try them but I have already been in touch with the asset manager and at the moment I have been unsuccessful in getting their help - they have said that having not used the reg machine we are in breach of the T&C's (despite the fact there is no mention of these on the site)

It might be worth a few people getting in touch and seeing if we can convince them to intervene

I am a little further down the line than yourself and I have been issued with particulars of claim (link on the post above)
