Laser Eye Surgery takes longer to heal

    If it were me I would be pleased that my wife had benefitted from the surgery and her eye had healed.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I am pleased that she has benefitted from the surgery and that her eyes have healed.

    However I was told by the clinic that she will be better after three days and she wasn't. That constitutes misselling and I am entitled under my consumer rights to reclaim the money spent.

    No you're not, you still have to pay for the service provided.


    In this case the ombudsman's decision is fair. You can't really expect a full refund can you?

    I think its mad you got anything back but then I think its mad to have eye surgery done on holiday.

    No can guarantee recovery time scales from eye surgery. If your wife took 2 monthes to heal for one that most people took a few days to recover it is a fair bet she would have taken a year to recover from the other surgery.

    I have plenty of paitents that have never 'recovered' from eye surgery in that they need drops permenantly and struggle with night driving

    Surgery can and does go wrong and in most countries have this tied up contractually.

    I think you are lucky to get anything back at all.

    But you are bound by the consumer rights in the country you made the purchase in, which unless I missed it I don't think you have said?

    Which country were you in and how aware are you of the consumer rights in that country?
    I would never have chosen to buy the cheaper option at the time as it would have (and did) ruined my holiday.

    And what about your wife's holiday? Was hers ruined as well or was it just yours?

    Oh, do you have some information that the rest of us are not privvy to?

    Where was this holiday taken?

    Was the procedure booked and paid for in the UK before the OP and his wife left for their holiday?

    The ombudsman had the whole site translated in order to check

    Hi whilst away on Holiday, I paid for laser eye surgery for my wife on my credit card.

    Paid fro while away not beforehand

    The ombudsman has, probably, got this wrong. Based on what you've said, I think you were actually entitled to nothing from the bank. So in my view you should take what you've been offered.

    You paid for the surgery, but your wife had it. This would normally break what's called the "debtor-creditor-supplier" relationship which would need to be in place for the bank to have any responsibility in the matter.

    Don't look a gift horse in the mouth. Did you get a final decision from the ombudsman or did they just suggest the bank do something and they agreed to do it?
