Parking Eye - with strange circumstances

Hi - this is my first post so be gentle :)

This is a strange one. I got a ticket through the post for parking in an M1 service station for 6 hours. Not everything is as it seems though and I have highlghted the specifics below:

1. I was not parked in the carpark at the time stated
2. They have a photo of me entering and existing the carpark
3. I went through the service road and went South down the motorway to visit my parents
4. I came North and back onto services and through service road home

THIS IS WHERE IT GOES WRONG.....

5. I pick up my GF and go back through service road to get a coffee from Starbucks on way north
6. I exit the services NORTH bound
7. The camera clocks me and logs my time parked in the car park.

It is a company car so the ticket went to my employer. I wrote a polite letter explaining the situation but they said my claim was invalid. I then ignored them for a while.

Now I have a letter from a debt collection agency in relation to the parking.

I genuinely did not park there although I have been naughty using a service road. What do I do now - do I ignore, appeal or what? Surely a photo entering and leaving is not evidence enough for a court case?

    You need to email ParkingEye with evidence of the two visits (e.g. a witness statement from your gf, plus an indication of the sort of timings).

    You can sue them for 3 figure compensation for this:

    They do this all the time - far too often - and had no cause to obtain your data so you could get compensation:

    HTH - get it cancelled then send an ICO complaint online, as a first step to getting maybe £250 compensation if you can show this has caused significant distress.

    You need to show that the 1st photo was on the south side and the 2nd on the north.

    That should do it and just say you have been double-dipped.

    If there is a back door to the services that is not covered by ANPR that can be used by members of the public, then they are Friar Tucked. r


    If they were foolish enough to try a claim, you do not have to prove anything, they have to prove that the driver did not use it.
    You never know how far you can go until you go too far.

    nothing "strange" about it , its a common occurrence with ANPR cameras and computers trying to do the work (its known as a double dip, do some reading about it)

    You only have to prove distress, not significant, much lower bar

    For once, I am not 100% behind The Deep on that statement. What he writes should be correct, but unfortunately, we have come across some very dodgy judge decisions on here and off line. You could strike unlucky by getting one of these.

    If it does get to court, then come back here and we can help further, but you would need a google earth map of the area and slip road, probably re-visit to take pictures to show that there are no cameras on slip road exit and also photos of both sides entry/exit motorway exits to show that the pictures came from different sides of the motorway thereby proving you did exit via the slip road.
