Birmingham broadway plaza apcoa parking charge

Hi there

I received a parking charge from APCOA for parking at Birmingham Broadway Plaza. I have no idea why this has been issued as I parked whilst at the Odeon Cinema under their 3 hours Free Parking for customers and entered my VRN at the foyer kiosk as instructed.

I wrote to APCOA to appeal with my cinema receipt, but have received a "sorry you should have used the foyer kiosk" reply - I did use the foyer kiosk!!

I would like to appeal to POPLA but my grounds for appeal are thin on the ground - other than the fact that I did everything right and still got a ticket. I cannot claim "poor signage" as my original appeal states that I followed the instructions given. Whilst I have not said I was driving the car, I did say in my appeal that I entered the VRN at the kiosk so not sure where I stand there. "Reasonable loss" no longer appears to be a defence. So I am left with "no breach of contract occurred" and APCOA's right to issue parking charges I think?

Can anyone advise any other appeal points I can make?

    Any 0 (zeros) or O's in your vehicle registration number by any chance?

    Have they sent you a POPLA code?

    Always use 'unclear signage' no matter what. Always use 'no landowner authority' (both are templates in post #3 of the NEWBIES thread). And start by telling POPLA this and putting APCOA to strict proof that the VRN was not input, because it was:

    DO NOT rely on that alone or it's easy to lose at POPAL (not that it would matter! Still not a charge to PAY!). The point of the long POPLA templates about signs and landowner authority, deliberately detailed, is to make APCOA fold.

    It is a shame you shot some toes off by appealing saying who parked the car. 'No keeper liability' would have killed this stone dead but you binned that!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
