Hello
I have lived for 11years renting of the same company with one other person, now that person is moving out and someone else will be named on the tenancy. the company has asked for £100 fee for credit check and references of the new person.
Also they have asked £100 from me, the existing tenant for 11years, which is for reference checking. I have said they are the reference having been with them for 11years.
I want to tell them where to go and what i think, but need a roof over my head.
is there a law about fair and reasonable charges.

What process are they proposing?
1) to mutually terminate the existing tenancy [in your name (A) jointly with the departing tenant (B)], and set up a brand new tenancy in the joint names of A & C? It is then normalpractice to re-reference all joint tenants for a new tenancy.
Additionally they should return A & B's deposit and take a new deposit from A & C. And do a new inventory for the new tenancy.
2) Alternatively they could assign B's position to C, via a Deed of Assignment. This is a legal document that A, B, C, and the landlord/agent all sign, with a witness, which transfers allB's liabilities, rights, and responsibilties to C.
No new tenancy is needed as the existing one continues (but with the substituted name). No acton is needed re the deposit, or the inventory.
In this case you don't need vetting as you are not starting a new tenancy. However there may be a fee for the Deed, the cost of which could be borne by whoever you choose - B, C, or all 3 of you.0 -
I appreciate you have a long history with the agent/landlord but referencing covers more than just this.
As said above if the agent is starting a new tenancy with yourself and this new housemate then the charge may be reasonable. However as a landlord I would waive referencing for a tenant of such long standing, so you can always ask the question.It may sometimes seem like I can't spell, I can, I just can't type0 -
If you're in England then the letting agency more or less has carte blanche to charge you what they like. It wouldn't do any harm to try and negotiate the price down.
How well do you know this person that you'll have a new joint tenancy with?0 -
