halifax ppi reclaim question

:confused: Hi there
I am trying to find out about a claim I have about my PPI
I took a loan with halifax for £5000 in 2005 and last week asked for a copy of my original agreement.
This arrived today and on looking through it I noticed that I had not ticked the box asking for PPI, but it is still being charged:confused:
I phoned the halifax and they said that as I hadnt signed the box it should never have been added to my loan :mad: so they were in the wrong. Does this mean they dont look at the paperwork when they ok a loan???:eek:
I was also told that I have paid it all as this is the first thing they pay when they get my repayments each month and the capital is paid off last, so in the last 2 years my repayments have been paying for the PPI I didnt agree to in the first place.
They are calling me back in the next few days to discuss a solution to this.
The question is...what can I ask for?

The total already paid to PPI I suppose is the least they owe me.
but can I ask for interest?
can i ask for compensation :o for having charged me for a product I asked not to have (in writing)?
any help would be great

    I would certainly request the full repayment of the premiums paid plus interest and an amount for compensation. It is the least they can do in the circumstances.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

  • With halifax loan agreements you do not tick a box for ppi (Personal Loan Repayments Cover). You have to sign in 2 places

    Firstly on the application form which states the amount borrow, term and loan reason, and then secondly you sign a second time for ppi after signing for loan. Then the staff member sings underneath

    Have they sent you a copy of the original agreement that was signed?

    Your own agreement copy says how luch was borrowed, monthly payments, apr. How much in interest for ppi and loan and the total. It breaks it down on first page?????? Does yours say this?

    yes they sent me a copy of the original loan agreement that was signed
    There is a box to tick for ppi and a box below for signatures.
    The box is unticked but the box below is signed
    The loan was done online and by courier and the pack that came with the agreement said to sign in both places even if you dont want ppi

  • ah i see - so did you select ppi when applying online?

    courier can't offer any advice on it

    what about the first sheet that has a Yes box or a no box (not the agreement)

    The problem is a new agreement would have had to be signed because all the figures would have been incorrect on the one you did sign

    when i spoke to them today they agreed that it was not signed and should have been changed but wasn't

  • Yeah thats what I mean it should have been changed and a new agreement sent out to be signed. The existing agreement should not have been signed or is invalid

    you say you did sign for the ppi though?? I know what you mean by the tick, but the signature is the important thing though

    how many years have you got left?
  • yes it looks like I did sign the bottom box not knowing it was for ppi

  • I think its going to be harder to prove this as you signed for the agreement, the ppi and the costs and applied online yourself, rather than being keyed by an adviser

    see what they have to say about the box though

    i asked about time left, as to cancel ppi now they usually ask you to take a new loan with ppi to repay old as the ppi is currently forming part of the agreement and can not just be removed

    Dont know if anyone was interested but I thought I would give an update on the progrees (or lack of it) from Halifax.
    They agreed it was a mistake on their part on 26th Sept.
    Since then I have had 3 letters from them.
    1 saying thanks a lot we will contact you within 4 weeks.
    2 saying still investigating will definately contact you before 20th November.
    3 on 20th Nov saying sorry its taking a while but we will ne contacting you shortly....Dont call me shortly. (sorry too many airplane films)
    Phoned them on Tuesday 4th Defc to ask what was going on and was told that they had got round to my complaint now and I would receive a full response by todays post.
    have just been on the phone to them as there was nothing in the post from them and was told that my complaint is now the oldest one they have and that someone has been assigned to it and will contact me soon.
    I ended up in tears on the phone when he said "thanks for your patience"
    I then sobbed to him that I have a teenager, a ten year old and a 7 month old baby who is teething so believe me I have no God damned patience left pal.
    I know I should remain calm but he was so much like an MP cos he never answered any question with a straight answer, I just wanted to scream.
    Anyway I feel better offloading on here so I will go and do some housework and slam a few doors.
