Shared driveway nightmare
Hi all. Looking for a bit of advice as we have just again come to blows with the neighbour over shared driveway.
Essentially we own the strip that runs down to a set of garages. And the section I'm from of our garage.
The neighbour owns just the section in front of their garage but has right of way across the driveway to allow him to get to his garage.
They have recently acquired a third car which means often they cannot fit and end up parking on the long run down to the garages (on the part we own).
Are the allowed to do this? Ie does the right of way allow them to park? And secondly am I allowed to park on this section (as long as I don't block their access)

Yes, so long as you don't block their access.
The question is what lengths you want to go to, in order to enforce this. Court injunction...?0 -
If he only has right of access across it, then he can't park on it.
If it is your land, you can park on it, but he has right of access, which means you have to move at any reasonable time, so he can.
The reality is you would be so tired of him knocking the door to ask you to move, that you would leave the drive clear.
Round here, the estate builders squeezed a couple of extra houses in, so most have a shared drive, that they both appear to own from their deeds....
(My deeds say I own 6 feet of the house behind's garden, but I can't as it was built years before mine, what happened is my house is actually about 6 feet further back than it should be, but my deeds give measurements from my boundary which is 6 feet further back than the original plans....)I want to go back to The Olden Days, when every single thing that I can think of was better.....

Just find lots of reasons to need your car out when he is watching a big football match/having his dinner etc., then he will get tired of it and leave the drive clear.
Don't you like chipshop chips at 10 pm?
I want to go back to The Olden Days, when every single thing that I can think of was better.....

Thanks all. Yes I don't want to go too far. I'm going out of my way by not doubling the cars up in front of my garage so they other neighbours can turn into it to get out as it's very tight. Which means we park one down the strip we also own. But now he is too just because he's got too many cars0

It is a pain having this type of layout and one fears it will be escalating. Question is how do you reach common ground. Yes it's all owned by you albeit access to his garage however if you park on the drive and he needs to get out of his garage late at night that is going to be a nightmare for the both of you. Glad I don't have a drive or garage I just dump mine on the public highway0

Where I park currently doesn't block anyone. There is more than 2 car widths so that's OK. If I double up in front of the garage it means everyone has to reverse in or out.0

Umm different picture (layout) to the one in my mind. Single track leading to the two garages at the rear of the house but seem to be wrong0
