PPI claim- should I start again?

Hi, I'm hoping someone can help me with my PPI claim. A few years ago, I wrote to one of my store card providers as I believe they mis-sold me PPI. They wrote back and told me I signed the form, so tough luck (which I was expecting) However, the copy of the signed paperwork they sent me was not mine, but that of my late father. Obviously this is a massive breach in data protection (lucky we have an uncommon surname so it didn't go to a stranger), but I also found it very upsetting to see my father's signature again.
So much so, that I abandoned the claim and did not contact them again, nor the ombudsman. Now, I'm ready to contact them again. Should I refer to my previous claim, or start a brand new one?

    Are you alleging that the Bank sent you another account holder's documentation? Or are you saying your father signed your documentation?

    Either way, your PPI complaint was over years ago. The reason they gave for rejection will still apply and you can't repeatedly complain about the same finance.
    Should I refer to my previous claim, or start a brand new one?

    You can make a separate complaint about them apparently sending you someone else's documents, but that is unlikely to result in a refund of PPI.

    Whilst its obviously very wrong for them to send you your late fathers paperwork by mistake and naturally upsetting its not actually a Breach of the Data Protection Act for the simple reason that the act only applies to living persons.
  • My store card sent me my fathers information, yes. For a storecard he had himself with the same company, signed several years before I was even 18. Very strange mistake to make.

    You could say you don't think they investigated your complaint properly because they seem to have referred to the sale of PPI to your late father instead of you. If this was some time ago they may not agree to look into it again, but you can always ask them.
