Dropped kerb application refusal help!

Your help would be appreciated...


I made an application for a dropped kerb to my council which I pay council tax to which is Waltham forest. They called me today to say although I pay my council tax etc to them, the maintenance of the road is actually done by Newham so I need to speak to them regards the dropped kerb application.


The maintenance of the road agreement was apparently made between the 2 boroughs roughly 10 years ago.


Waltham Forest do allow dropped kerbs and neighboring properties do have them but newham on their website state they do not allow them anymore due to:


removing gardens to create parking spaces is bad for the appearance of the street
they can cause problems for pedestrians
if the garden is small some vehicles may be partly parked on the pavement
they reduce the amount of street parking.


Can someone help me with regards to who I can contact to take this further?

    You should write to Newham to explain your exceptional reasons for needing, not wanting, a dropped kerb. If you can provide evidence of the requirement, such as limited mobility, they may make an exception. If it's just because you'd prefer to park on your own land rather than run the lottery of trying to park on the street, they will refuse on the basis of the reasons they have already given.

    There may be two issues here.

    In planning/highways terms, you'd have to satisfy Waltham Forest that your dropped kerb and associated off-road parking meets planning and road safety requirements. They are the statutory local authority.
    Waltham Forest Council as the Highways Authority will deal with the request with or without modification, or may propose alternative works or reject the request.

    Then you'd have to get a cost from Newham as the highways maintenance authority (or another contractor approved by Newham) and get them to actually do the work.
    A kind word lasts a minute, a skelped erse is sair for a day.

    The application that I sent to WF hasn't even been considered as they said Newham has to deal with it. My front garden meets all the requirements that WF state on their application but they just told me over the phone that I need to speak to Newham.


    my worry is that Newham will reject it as they don't allow any dropped kerbs to be built in their own borough.


    The point on my side is that I am a WF resident and even though the highway is down to Newham, I should still get a dropped kerb on the basis that WF is still the local authority and neighbouring properties have dropped kerbs.


    If newham rejects this then is there anyone higher up in the chain I can contact to reolve this/advise me?

    Seems to me you should phone Newham stating this query about the road being in WF but under Newham jurisdiction, and see whether they say no, or whether yours counts as a special case which could be considered.
