Constant Roadworks Noise Compensation from Thomsons

We returned yesterday from a weeks holiday at the Hotel Angela in Fuengirola. On arrival the main entrance to the hotel was closed and there was a massive amount of noise from heavy mechanical equipment digging up the road from 8 in the morning up until sometimes 8 at night right outside the hotel. These roadwork started at least a week before our arrival and were still ongoing when we left. We would imagine they would continue for a good few weeks yet. It really spoilt our holiday. Thompson must have been aware of this issue before we departed but did not contact us with the offer of a refund or change of accommodation.We complained to the Representative at the hotel but got nowhere. We would not have stayed at this hotel if we had known about the constant noise beforehand. We took photographs are not lodging a claim for compensation against Thomson holidays. What is our chances of success and our legal position as the roadworks started well before our departure. Was it not incumbent for Thomson to have contacted us.

    We were staying at The Hotel Angela when the very noisy road works started. It spoilt the latter part of our holiday.as there was no much warning there was very little we could do. However Thomsons should have advised guests who had booked and not departed offering alternative accommodation. I would have thought if they continue to send customers there because of the excessive noise, there is a case for claiming compensation. Maybe someone with a bit of legal knowledge could point you in the right direction, but taking on a big company may prove difficult. At least you have photographs to back up your case.
