Hi there,
I've recently received a letter from DRP on behalf of Excel Parking Services who claim that I did not have a valid ticket when parking. This is not the case, I have the ticket I purchased.
However, I moved in November and had not updated my details with the DVLA, which means that Excel have stated that they couldn't get hold of me and therefore passed the debt on. I contact Debt Recovery Plus and spoke to an incredibly patronising man who explained that as it has gone passed 28 days there is nothing I can do and I have no rights to appeal.
Is this the case? It doesn't seem right, even if my details were wrong with DVLA. I do still have the ticket, although I can see that instead of the vehicle reg it simply has an 'I' listed on it - invalid?!
It seems there are many people that have been in a similar situation, and I wondered if I had any legal case for not paying or if I should just pay?
I have until 9 March to pay £160.

And DO NOT contact DRP again.
Post four of the Newbies Sticky at the top of this forum tells you exactly what to do with DRP!
However, this would be a good time to update your details with the DVLA.0 -
It is not a fine.
Debt collectors have absolutely no powers and can do absolutely nothing except send you free bog paper.
No of course you shouldn't pay.
How long after you moved did you inform the DVLA (V5 and driving licence. You have to do both separately as the two departments don't talk to each other.) Did you not do mail re-direct when you moved?
Have you complained to the landowner/retailer where your car was parked?
How did the debt crawlers get your address?
Anyway, I would appeal to Excel telling them you moved but the DVLA hadn't updated your keeper address when the PPC applied for the keeper details.
They will probably say you are out of time, but at least you will have engaged with the should it ever go to court. The advice to ignore parking tickets has not been given since the law changed in 2012.
Use the IPC template in black you will find in the NEWBIES thread but do not reveal who was driving. Send a copy of the ticket you bought and carefully state THE DRIVER had a valid ticket so they have breached their Kadoe agreement with the DVLA and breached the DPA as they had no reason to obtain your details.
Never ever 'phone a private parking company. Never, ever, ever contact a debt collector, ever. Don't do it again, ever.
Did you admit to being the driver when you called the debt crawler? I hope not.

The conversation skills of DRP probably result from being trained at the Plebbies training school. Once fully trained, they are then sent to DRP so they can demonstrate to the motorist their new pleb skills
IGNORE DRP ... DO NOT PAY THEM £160
You must let the parking company know your new address as with the DVLA.
(that includes your drivers licence as the DVLA do not have the knowledge or technology to match the two together)
Excel are well known for having very dodgy pay machines so if you have your receipt send them a photocopy.
Again, do not open up a conversation with Excel

I shall contact Excel. I am I right in thinking that a collections company are not allowed to collect for a debt that isn't owed? I'm concerned that they'll push this further.
