Fence and house being sold.

Quite angry this afternoon. House next to me was sold about 5 years ago and person who bought it put up an unsightly fence on to of the adjoining wall. She would not take it down and I missed my chance to ask her to before she sold. House was then bought by a couple for their son and wife and baby to live in. The relationship foundered and wife was left their alone and they threw her out last week. I thought the son might move back in and before she left I pointed out that the fence at the back was falling down and needed replacing and could she tell them. There is also an ivy that grows up my house that is rooted on their side. I believe they are responsible for the fence as it is on their left when you stand outside with their house behind them and the old couple who lived there for years replaced it whilst we were there.
I found out a couple of weeks ago that the neighbours on the other side of them ( who have also just sold ) rebuilt their adjoining wall with a fence on top and these neighbours contributed to that.
I got the peoples email and sent an email about the fence and ivy but did not hear back.
Yesterday the son was outside clearing rubbish and told me the house was going on the market. I reminded him about the fence and asked if they didnt mind removing the front fence before they left. ( It is the only house in the road with a front fence and he said he would talk to his parents.
However later yesterday a sold sign appeared and when i spoke to the agents they said it was under offer and therefore I might not be able to do anything about the fence.

    I'm sure the rule is those that pay for the fence own the fence, not the side the fence is on. As long as it's on your land you could replace it, or ask if they mind if you replace it.

    There's not really much you can do about a neighbour's tatty fence - unless there is some kind of covenant in your deeds which says the neighbours must keep it in good condition.

    One option is to put up your own smart fence, just on your side of the boundary, so that it hides their tatty fence, when looking from your side.

    Another option is to offer to contribute to the cost of replacing the fence, in the hope that would encourage them to do something.

    Although, if the house has been sold, maybe the new owners will want to replace the tatty fence anyway.

    In short - it's not your fence, it's theirs.

    If you wish to look at a nice fence, buy your own.

    That's how it works.

    Ive been cutting the ivy and pulling it off my wall for 2 years but the root is behind the fence and their conservatory. I just would like the root pulled out.

    And Ive just replaced the whole fence on the other side of my property.

    Just as the fence isn't yours, neither is the Ivy. The neighbours can do whatever they would with their land, and can choose to ignore your demands.
