Apcoa PCN - best approach please

First PCN in years, so help appreciated.


Vehicle drove through a rail station car park, marked ANPR used, private road, couple of other small signs you can't really read without stopping at the entrance and getting hit from behind.


Drove out the other side within 5-10 mins depending on traffic on through road without stopping other than for traffic.


Vehicle driver parked free at work a few mins later, and drove again through car park in the evening no stopping.


Now received PCN addressed to registered keeper, some 35 odd days later alleged contravention of use of private car park without making valid payment.


As vehicle didn't park just drove through how can they try and charge?


Two photos on notice, one from morning entry and a dark one from evening looks to be vehicle entering car park on way home.


Looks like they missed morning exit a few mins after entry and think vehicle stayed all day.


Is above enough to send and appeal, no mention of bylaws on paper received.

    A classic case of double dipping due to the use of unfit for purpose ANPR technology.

    Pease read the Sticky thread for NEWBIES then send the BPA template in blue you will find there. Carefully add that this was a double dip and the scammers had no business getting keeper details from the DVLA which was therefore a DPA breach.

    Do not otherwise edit the template, and do not reveal who was driving.

    Only ever refer to The Driver and The Keeper, including on the internet.

    APCOA won't care what you say; you just need a POPLA code so you can appeal to POPLA and get this cancelled. This is why you should use the blue BPA template appeal from the NEWBIES sticky thread.

    If you want to fight back, you could send APCOA a separate Section 10 Data Subject Notice as decribed in this thread: https://forums.moneysavingexpert.com/discussion/5585388.
