PCN at Woodside Leisure Park - Do you think I would win the appeal?

Hi everyone,

Twelve days ago the driver was given a PCN for not parking correctly within the bays at Woodside Leisure Park in Watford. This is a free car park where you can stay as long as you like. There is a 2 foot gap between the bay the driver parked in and the start of the bay next to the driver's space (as the car park is at an angle) so they wasn't even taking up 2 spaces. The reason they parked like this is due to a car to the left of them taking up part of their bay.

They read the signage of the car park after they got the ticket and it does say that you must park correctly within the bays and the evidence taken by the parking company (UKPC) shows that they are 1 wheel width outside the bay. The photos taken by UKPC were taken at night in terrible quality and the photo of the sign that they've taken is eligible. The signs are really small and not clear at all to see (especially at night).

My question is would they lose the appeal with POPLA due to the fact that the signs state that you must park within the marked bays and the photos prove that they haven't?

Also can UKPC even charge them for this as the carpark is completely free and they wasn't taking up 2 spaces?

I'll try and add the photos they've taken so you can see for yourselves.

Cheers.

PLease edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper who are two different people as far as this is concerned.

Then, please read the Sticky thread for NEWBIES before sending the BPA template in blue you will find there. Copy and paste and send, do not edit and DO NOT reveal who was driving.

Then, start reading up on how to beat the scammers at PoPLA. Don't you dare think you did anything wrong, or that the scammers have any justification for their actions. UKPC were caught doctoring time stamps on their 'photo "evidence" just so you know the type of people you are dealing with.

Take 'photos of the signs and car park entrance to help with your appeal. Make sure they are time stamped or include a picture of a newspaper showing the date and banner headline.

the car park is at an angle

    Read this

If the space is 1mm less than 2.4 metres, complain to the BPA, Trading Standards, (in writing), the Council Planning Department, the Directors of the park, local papers, and the local Tourist Board. Write bad stuff on their Facebook and Trip Advisor websites.

UKPC are cheats and scammers and have no place in a leisure facility such as this.

No because you won't be saying who parked or the story of what happened!

NEWBIES thread has the templates for first appeal & (in post #3 of it) POPLA templates. Yes it's up to date, yes you appeal online on day 26, and no, the first 14 days means nothing.

You appeal as keeper at that time for a good reason, and then you win at POPLA when UKPC forget to serve a NTK, as explained in the sticky thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
