Party wall building insurance

Hi all!
I was after a bit of advice. We are currently in the process of doing up a back bedroom and found that next doors bathroom is causing damage to our plaster. We discovered that there is no solid wall between the two properties at this location and only two lath and plaster walls. We currently are in the process of getting a quote from a builder to rectify this problem and wondered if we had any grounds to seek an insurance claim if anyone has had a similar experience?
